CHAIR BERT STEDMAN called the Senate Transportation Standing
Committee meeting to order at 1:33 p.m. Present at the call to
order were Senators Bishop, MacKinnon, Egan, and Chair Stedman.

CHAIR STEDMAN announced the consideration of HB 204.

WILLIAM JODWALIS, Staff, Representative Kawasaki, Alaska State
Legislature, Juneau, Alaska, provided a summary of HB 204 as
follows:
House Bill 204 would add, "vehicle in the act of
preforming maintenance road-service work," to the
existing statute; it stipulates that drivers who are
approaching certain kinds of stationary vehicles on a
roadway must vacate the current lane into the next if
applicable and if not, slow down to what is reasonable
in consideration of weather and road conditions.

Page 1, lines 5 - 6:
Delete "vehicle in the act of performing
maintenance or road service work,"
Page 1, line 8, following "lights":
Insert ", or that approaches a stationary vehicle
in the act of performing maintenance or road
service work,"
CHAIR STEDMAN objected for discussion purposes.
SENATOR MACKINNON explained that on page 1, lines 5-6, "vehicle
in the act of performing maintenance or road service work," is
moved to the end of line 8; and on page 1, line 8, ", or that
approaches a stationary vehicle in the act of performing
maintenance or road service works," is inserted.
She noted that her office met with the bill's sponsor as well as
all committee members that are in attendance. She explained that
the amendment is in support of the sponsor's work on protecting
folks in the right-of-way. She said the legislation does not
require flashing lights because an emergency vehicle is not
involved where construction workers are in the roadway, but the
intent is to protect the construction workers.
SENATOR MACKINNON disclosed that her office spoke with Don
Etheridge, [AFL-CIO lobbyist], who spoke in favor of HB 204; and
with the Alaska Department of Transportation and Public
Facilities (DOT&PF). She said to her knowledge the amendment is
acceptable to all in accomplishing what the sponsor was trying
to accomplish.
CHAIR STEDMAN removed his objection to the adoption of the
amendment.

MIKE LESSMAN, Legislative Liaison, Office of the Commissioner,
Alaska Department of Transportation and Public Facilities,
Juneau, Alaska, said the department is supportive of Senator
MacKinnon's amendment to HB 204.

CAPTAIN DAN LOWDEN, Deputy Commander, Division of Alaska State
Troopers, Alaska Department of Public Safety, Anchorage, Alaska,
disclosed that he has not discussed the bill with the
commissioner but noted that discussions with the commissioner's
office has indicated that the department is not opposed to HB
204. He asserted that the Alaska State Troopers are supportive
of making the roadways safe. He opined that the committee's
amendment does not change a lot of the department's position on
the bill.

30-LS0685\J as amended, from committee with individual
recommendations and attached fiscal note.

CHAIR STEDMAN announced that there being no objection, the
motion carried.

Chair Stedman adjourned the Senate Transportation Committee at
