LEGISLATIVE COUNCIL
July 12, 2002
1. ROLL CALL
The Legislative Council meeting was called to order at 10:11 a.m. by Senator

Cowdery, Legislative Council Vice-Chair, in the Anchorage 2 floor Conference
Room via-teleconference.
The roll was taken. In attendance were Council members: Green (late arrival),
Berkowitz, Murkowski, Ogan (via-teleconference), Porter, Rokeberg, Cowdery
(via-teleconference), Donley, Halford (via-teleconference, late arrival), Stevens,
Torgerson (via-teleconference), and Elton (via-teleconference). Members
absent: Kott and Kelly. Staff present were: Varni, Cook, Collins, Ibesate,
Luckhaupt, Price, Warenda, Schofield and Popely. Others present were: Dale
Bonduant and Bob Erwin.
2. APPROVAL OF JUNE 24, 2002 MINUTES
Representative Porter moved the minutes of the June 24, 2002 meeting be
approved.
YEAS: Murkowski, Ogan, Porter, Rokeberg, Berkowitz, Cowdery,
Torgerson, Stevens and Elton
NAYS: None
ABSENT: Green, Kott, Donley, Halford and Kelly
The motion passed 9 - 0.
3. FY 03 LEGISLATURE UNALLOCATED REDUCTION OF $200,000
Pam Varni, Executive Director, Legislative Affairs Agency informed the Council
that the $200,000 unallocated reduction spread to the Legislature's budget would
need to be decided by the end of July because of OMB deadlines to show the
authorized budget for FY 03. Spreadsheets were provided per the Council's
request as to the amount of lapsing funds for FY 02. It was explained that the
Legislative Operating Budget received the largest decrease in funding for FY 03
and should not be hit again with the unallocated reduction.
Representative Green arrived and took over as Chair.
Discussion followed.
Speaker Porter moved the Unallocated Reduction come from the following areas:
$100,000 from LB&A Committee Expenses, $55,100 from Administrative
Services deleting the Information Assistant - Immigration Specialty position and
$44,900 from the Legislative Council Chair.
YEAS: Green, Murkowski, Ogan, Porter, Rokeberg, Cowdery, Torgerson,
Halford and Stevens
NAYS: Berkowitz, Donley and Elton
ABSENT: Kelly and Kott
The motion passed 9 - 3.
4. OTHER BUSINESS
Chair Green introduced Mr. Bob Erwin and Mr. Dale Bondurant, with the Alaska
Constitutional Legal Defense Conservation Fund. Mr. Dale Bondurant testified
on the constitutionality of the rural subsistence priority and would like Legislative
Council to pursue a decision from the U.S. Supreme Court.
Further discussion followed.
Chair Green recommended that Legislative Council delay any action till the next
Council meeting so that the majority attorney can review this case.
Senator Donley moved that the Katie John case be brought up at the next
Legislative Council meeting. Senator Donley recommended that Ted Popely
prepare a proposal in a written motion form showing amount of dollars and
specific details of the proposal so that the Council could vote up or down on the
proposal/motion.
There was no objection made.
Senator Halford joined the meeting via teleconference and Representative
Murkowski left the meeting.
Senator Halford made the motion to allow the Salmon Task Force the authority to
contract up to $50,000 with the agreement/approval of the Presiding Officers and
Chair of Legislative Council.
YEAS: Green, Murkowski, Ogan, Porter, Rokeberg, Berkowitz Cowdery,
Donley Torgerson, Halford, Stevens and Elton
NAYS: None
ABSENT: Kelly and Kott
The motion passed 11 - 0.
5. ANCHORAGE OFFICE SPACE APPROVAL - RFP #380
Senator Donley made the motion that Legislative Council go into Executive
Session to review RFP #380. Pam Varni, Executive Director, requested that staff
to Legislative Council and appropriate Agency staff in Juneau be able to remain
in Executive Session; Mike Warenda, Wen Ibesate, Gayle Collins, Karla
Schofield, Tam Cook, Linda Hay, Jan Price, and Jerry Luckhaupt.
YEAS: Green, Ogan, Porter, Rokeberg, Berkowitz, Cowdery, Donley,
Halford, Stevens and Elton
NAYS: Torgerson
ABSENT: Kelly, Murkowski and Kott
The motion passed 10 - 1.
Legislative Council came out of Executive Session at 11:35 a.m.
The Meeting was adjourned at 11:37a.m.
