SB 176-SEX DISCRIMINATION IN HEALTH CLUBS
MR. KRIS KNAUSS, Staff Aide to Senator Drue Pearce, explained line
7 was deleted in the committee substitute.
SENATOR LEMAN moved to adopt CSSB 176 (RLS)(1-LS0935\H) as the
working draft of the committee. Without objection it was so
ordered.
SENATOR LEMAN objected and asked Mr. Knauss if there is a reason
to include, after the word "females", "to protect the privacy
interests of its users". He asks whether the owner of a facility
has to demonstrate the reason for excluding certain sexes.
MR. KNAUSS stated that SB 176 had been discussed with Legal
Services and the language in SB 176 should not pose litigation
problems.
SENATOR LEMAN removed his objection.
SENATOR ELLIS asked Senator Leman if the inclusion of the phrase
"protect the privacy of interests of its users" creates a burden on
the owner of the facility to prove that is why the facility is
being limited to one sex.
SENATOR LEMAN replied it creates a standard that must be met.
SENATOR LEMAN moved all versions of SB 176 with individual
recommendations and accompanying fiscal notes for calendaring at
the Chairman's discretion. There being no objection, the motion
carried.
