CHAIR FRED DYSON called the Senate State Affairs Standing
Committee meeting to order at 9:37 a.m. Present at the call to
order were Senators Giessel, Coghill, Wielechowski, and Chair
Dyson.
SB 206-VEHICLE REGIS/LICENSING/ACCIDENT REPORTS

CHAIR DYSON announced the consideration of SB 206 and asked for
a motion to adopt the committee substitute (CS).

SENATOR GIESSEL moved to adopt CSSB 206, labeled 28-LS1531\N, as
the working document.
CHAIR DYSON found no objection and version N was before the
committee.

LARRY SEMMENS, Staff, Senator Peter Micciche, Alaska State
Legislature, Juneau, Alaska, sponsor of SB 206, explained that
the primary change in version N was to move contributing to the
delinquency of a minor under AS 11.51.130 referenced in Sec 4,
AS 28.15.046(c)(1)(C), to the misdemeanor section AS
28.15.046(c)(2). A 10-year look-back to July 1, 2004 was also
added to the applicability section to address Senator Coghill's
concern.
MR. SEMMENS highlighted three suggested amendments:
(1) Page 3, lines 26-30, reorder (C), (D), and (E) so
that (C) becomes (E) and (D) and (E) become (C) and
(D) respectively.
(2) Page 5, line 10, change (c)(2)(A)-(C) to
(c)(2)(A)-(D).
(3) Page 5, line 3, strike "successful completion of a
test of a licensee's eyesight."

SENATOR GIESSEL moved to adopt the forgoing conceptual
amendments.
CHAIR DYSON announced that without objection the conceptual
amendments were adopted. Finding no further questions or
discussion, he solicited a motion.

SENATOR GIESSEL moved to report SB 206, version 28-LS 1531\N, as
amended, from committee with individual recommendations and
attached fiscal note(s).

CHAIR DYSON announced that without objection CSSB 206(STA) was
reported from the Senate State Affairs Standing Committee.

HB 212-DRIVER'S LICENSING EXEMPTION: MILITARY

CHAIR DYSON reconvened the meeting and announced the
consideration of HB 212.

REPRESENTATIVE DOUG ISAACSON, Alaska State Legislature, Juneau,
Alaska, as joint sponsor, introduced HB 212. He explained that
the bill would allow the spouses of military service members who
transfer to Alaska the ability to retain their driver's license
from their home of record. Alaska statute already provides an
exemption for military members, but not their spouses. He noted
that 39 other states already extend this benefit to military
spouses and suggested that it would be very military-friendly
for Alaska to do the same. The proposed legislation would apply
only to spouses 18 years of age and older who have a legitimate
driver's license from another state.
CHAIR DYSON asked Ms. Thomas how HB 212 would impact the
Division of Motor Vehicles (DMV).

TIFFANY THOMAS, Driver Licensing Manager, Division of Motor
Vehicles (DMV), Anchorage, Alaska, stated that HB 212 would have
no impact on the DMV.
SENATOR GIESSEL suggested that the fiscal note should be
indeterminate rather than zero because licensure fees would be
lost.
MS. THOMAS agreed that the fiscal note would be indeterminate.
SENATOR GIESSEL commented that there's a difference between zero
and indeterminate.
CHAIR DYSON asked if she would like a finance referral.
SENATOR GIESSEL said she'd need to contemplate that.

SENATOR COGHILL asked if military spouses who subsequently
divorced would be required to get an Alaska license within 90
days.
REPRESENTATIVE ISAACSON replied yes if they continued to reside
in Alaska.
CHAIR DYSON asked if a divorce would affect the spouse's ability
to vote.
REPRESENTATIVE ISAACSON answered he assumed it would.
CHAIR DYSON found no further questions or testimony and
solicited a motion.

committee with individual recommendations and attached fiscal
note(s).
