CHAIR GIESSEL announced consideration of SB 163 [version CSSB
163, 29-GS2916\I, as conceptually amended on 4/1, was before the
committee]. She said the conceptual amendment referenced the
correct federal law and invited Ms. Hale, Director of the
Division of Water, to explain the differences.

MICHELLE HALE, Director, Division of Water, Department of
Environmental Conservation (DEC), Juneau, Alaska, explained that
40 CFR 230.3 was changed to 40 CFR 122.2 on page 6, line 14, to
reference the correct definition of "waters of the U.S." The
definition in 40 CFR 230.3 relates to the Dredge and Fill
Program; 40 CFR 122.2 relates to the Point Source Discharge
Program, which is the reference that should be used in SB 163.
SENATOR COSTELLO moved to report CSSB 163(RES), version 29-
GS2916\I as conceptually amended from committee with individual
recommendations and newly attached fiscal notes, one from DEC
OMB component 2062, dated March 31, 2016 at 3:15 p.m., OMB
component 3002 from DNR dated April 1, 2016 at 12:a.m., and OMB
component 486 from the ADF&G dated April 2, 2016 at 11 a.m.
There were no objections and it was so ordered.
