SB 109-CRIM HIST CHECK: ST EMPLOYEES/CONTRACTORS 1:35:55 PM CHAIR COGHILL announced the consideration of SB 109 and noted the proposed committee substitute (CS). He listed the individuals who were available to answer questions. 1:36:53 PM SENATOR KELLY moved to adopt the work draft CS for SB 109, labeled 30-GS1938\D, as the working document. CHAIR COGHILL objected for an explanation of the changes. 1:37:43 PM JORDAN SHILLING, Staff, Senator John Coghill, Alaska State Legislature, Juneau, Alaska, explained that the committee ordered a committee substitute for SB 109 to update the effective date from 2017 to 2018. In the process, Legislative Legal also made technical changes to the governor's bill to ensure that it conforms to the Manual of Legislative Drafting. He reviewed the following changes: (1) The paragraphs in sec. 12.62.400(c) were reordered to be in alphabetical order, and the definition of agency was revised to refer to the definition in sec. 39.90.290. (2) Throughout the bill, "current or prospective" was removed before "contractor," as the definition of contractor includes a current contractor and an applicant for a contract. (3) Section 3 of the bill was rewritten to create a new article. The numbering was updated to reflect this change. (4) The definitions in sec. 3 of the bill were moved into their own section. (5) The effective date was changed to July 1, 2018. MR. SHILLING noted that Hilary Martin with Legislative Legal was available if there were questions. CHAIR COGHILL asked Ms. Wojtusik to provide the administration's perspective of the committee substitute. 1:39:26 PM GENEVIEVE WOJTUSIK, Legislative Liaison, Department of Revenue, Juneau, Alaska, stated that the administration has no objection to the changes and appreciates the help. SENATOR WIELECHOWSKI asked if she supports the committee substitute. MS. WOJTUSIK said yes. 1:40:07 PM SENATOR KELLY moved to report the CS for SB 109, 30-GS1938\D, from committee with individual recommendations and attached fiscal note(s). CHAIR COGHILL removed his objection. SENATOR COSTELLO joined the committee. CHAIR COGHILL updated Senator Costello and asked if she wanted to object for further explanation. SENATOR COSTELLO said no. CHAIR COGHILL announced that without objection, CSSB 109(JUD) moved from the Senate Judiciary Standing Committee.
