SB 104-PERMANENT FUND DIVIDEND FRAUD/ELIGIBILITY
CHAIR RALPH SEEKINS announced that the Conference Committee
Substitute for SB 104 was the business before the committee and
that limited powers of free conference had been granted. He
noted that Version \C incorporates the amendments discussed at
the previous meeting and that the limited powers pertain to
Sections 35, 36 and 37.

SENATOR GRETCHEN GUESS asked for an explanation of the thinking
behind moving the effective date for the eligibility sections to
2007. She suggested a 2006 effective date wouldn't hurt and that
would make it possible for Olympic athletes to be eligible for a
dividend this year.

SHARON BARTON, Director of the Permanent Fund Dividend Division,
explained that the application period for the 2006 dividend,
which will be paid in October 2006, has closed.
SENATOR GUESS questioned whether the Olympic athletes would get
to count 2006 as a dividend year or just 2007 if the eligibility
section goes into effect in January 2007. She observed that the
2006 application considers eligibility in calendar year 2005 and
not in 2006.
MS. BARTON agreed; to be eligible for the 2007 dividend the
effective date should remain at 2006. Year 2006 Olympic athletes
would be eligible for the 2007 dividend.

SENATOR GUESS commented that in a year when Alaska had so many
Olympians it would be embarrassing to pass the bill and find
those athletes weren't eligible.
SENATOR GUESS moved to amend page 16, line 29. Change the
effective date from January 1, 2007 to January 1, 2006.
CHAIR SEEKINS found no objection and announced that Amendment 1
was adopted.
CHAIR SEEKINS found no further motions or comments and asked for
a motion to accept and forward the Conference CS for SB 104 to
the individual bodies.
REPRESENTATIVE McGUIRE moved to report Version \C CCS for SB
104, as amended, to the House and the Senate with attached
revised fiscal notes. There being no objection, it was so
ordered.

SENATOR GENE THERRIAULT noted that the drafters made the desired
technical change on page 8. The word "that" was changed to
"who."
