SB 17-CRIME COUNTERFEIT/NONFUNCTIONING AIRBAG 1:31:26 PM CHAIR CLAMAN announced the consideration of SENATE BILL NO. 17 "An Act establishing the crime of airbag fraud." CHAIR CLAMAN said this is the second hearing of SB 17 in the Senate Judiciary Committee. The intention is to consider a committee substitute. 1:31:42 PM CHAIR CLAMAN solicited a motion. 1:31:47 PM SENATOR TOBIN moved to adopt the committee substitute (CS) for SB 17, work order 34-LS0183\N, as the working document. 1:32:00 PM CHAIR CLAMAN objected for purposes of discussion. 1:32:18 PM BREANNA KAKARUK, Staff, Senator Matt Claman, Alaska State Legislature, Juneau, Alaska, presented the summary of changes for SB 17 from version \A to \N. [Original punctuation provided.] Summary of Changes Senate Judiciary Committee: Version A to Version N The Senate Judiciary Committee Substitute to SB 17 contains the following changes described below. • Establishes an exemption for the crime of airbag fraud for a person who discloses to the buyer or lessee that the vehicle contains an airbag that is inoperable, damaged, recalled, has previously been deployed, causes a vehicle's diagnostic system to inaccurately indicate that the vehicle is equipped with a properly functioning airbag, or results in an electric fault detected by a vehicle's diagnostic system after the installation procedure was completed before the sale lease, or trade of a vehicle • Clarifies the definition of a "nonfunctioning" airbag to mean a replacement airbag in all cases. 1:33:16 PM CHAIR CLAMAN removed his objection and CSSB 17 was adopted as the working document. 1:33:27 PM CHAIR CLAMAN opened public testimony on SB 17; finding none, he closed public testimony. 1:33:52 PM CHAIR CLAMAN held SB 17 in committee.
