CHAIR LOUISE STUTES called the House Special Committee on
Fisheries meeting to order at 5:30 p.m. Representatives Stutes,
Kreiss-Tomkins, Johnson, Ortiz, and Millett were present at the
call to order. Representative Herron arrived as the meeting was
in progress.

CHAIR STUTES announced that the only order of business would be
HOUSE BILL NO. 366, "An Act relating to commercial fishing entry
permits; establishing regional community permit banks and
regions for certain commercial fishing permits; relating to
commercial fishing entry permits and regions leased and
controlled by a regional community permit bank; relating to the
duties of the Commercial Fisheries Entry Commission and the
Department of Commerce, Community, and Economic Development; and
providing for an effective date."

REPRESENTATIVE KREISS-TOMKINS stated that a proposed committee
substitute (CS) to HB 366, to be offered for adoption, would be
forthcoming. He further explained that the intention is to have
a working draft made available for public review, as well as to
address constitutional questions that arose during the initial
hearing of the bill.

packet.]

CHAIR STUTES asked to have the question of constitutionality
addressed.
REPRESENTATIVE KREISS-TOMKINS deferred to Legislative Legal and
Research Services.

ALPHEUS BULLARD, Attorney, Legislative Legal and Research
Services, said HB 366 is constitutionally sound.
REPRESENTATIVE KREISS-TOMKINS asked whether HB 366 allows
ownership of a permit by any entity other than an individual or
a permit bank.
MR. BULLARD responded that only natural persons and regional
community permit banks would be allowed to hold permits.
REPRESENTATIVE JOHNSON called a point of order, and objected to
proceeding any further without having the proposed CS
distributed to the committee.
REPRESENTATIVE KREISS-TOMKINS pointed out that the comments made
relate to HB 366, as previously introduced.
