HB 97-SELF-STORAGE UNITS: LIENS; SALES [SCS CSHB 97(L&C) was before the committee.] 2:31:32 PM CHAIR CLAMAN announced the consideration of CS FOR HOUSE BILL NO. 97(JUD) am "An Act relating to self-storage facilities for personal property, including vehicles and watercraft; distinguishing self-storage facility liens from another type of storage lien; and excluding self-storage liens from the treatment of certain unclaimed property." CHAIR CLAMAN said that this is the second hearing of HB 97 in the Senate Judiciary Committee. The intention is to hear a Judiciary Senate committee substitute (SCS). He invited Ms. Kakaruk to put herself on record and explain the summary of changes. 2:32:07 PM BREANNA KAKARUK, Staff, Senator Matt Claman, Alaska State Legislature, Juneau, Alaska, presented the summary of changes for HB 97 from version R to version Y. [Original punctuation provided.] Summary of Changes Senate Judiciary Committee: Version R to Version Y The Senate Judiciary Committee Substitute version Y makes the following changes: • Page 2, line 3 • Delete "60" • Insert "120" • Page 3, line 10 • Delete "electronic mail and by the" • Insert "hand delivery, electronic mail if an electronic mail address was provided, send by certified mail with return receipt requested, or the" • Page 3, line 14 • Delete ", but not more than 20 days," • Page 3, line 16 following "electronic mail" • Insert "if an electronic mail address was provided," • Page 3, line 16 following "certified mail" • Delete "," • Insert "with" • Page 4, line 21 • Delete "or a lienholder listed on the vehicle title" • Page 4, line 24 • Delete "or lienholder" 2:34:09 PM CHAIR CLAMAN informed the committee that discussions with stakeholders took place prior to developing the changes included in the Senate committee substitute. 2:34:17 PM CHAIR CLAMAN solicited a motion. 2:34:23 PM SENATOR KAUFMAN moved to adopt the Judiciary Senate committee substitute (SCS) for CSHB 97, work order 33-LS0392\Y, as the working document. 2:34:37 PM CHAIR CLAMAN found no objection and SCS CSHB 97 was adopted as the working document. CHAIR CLAMAN noted that the Senate committee substitute, page 2, [line 3,] changed the timeframe from 60 days to 120 days. He remarked that there had been considerable discussion about the appropriate number of days. Ultimately, the Judiciary SCS included 120 days, largely because he believed it provided greater consumer protection than 180 days. He invited committee members to offer an amendment if they wished to further discuss or change the number of days. CHAIR CLAMAN found no further discussion or amendments and invited Mr. Nye to make closing comments on HB 97. 2:35:27 PM RILEY NYE, Staff, Representative Mike Prax, Alaska State Legislature, Juneau, Alaska, provided closing remarks on HB 97. He expressed appreciation to the committee for hearing the bill and said the bill sponsor, having worked with the committee on the Judiciary SCS, supports the changes. 2:35:53 PM SENATOR KAUFMAN moved to report SCS CSHB 97, work order 33- LS0392\Y, from committee with individual recommendations and attached zero fiscal note(s). 2:36:08 PM CHAIR CLAMAN found no objection and SCS CSHB 97(JUD) was reported from the Senate Judiciary Standing Committee.
