CHAIRMAN RICK HALFORD called the Senate Rules Committee meeting to
order at 1:58 p.m.
CHAIRMAN HALFORD opened the public hearing on CSHB 69 SEX(FIN)
(OFFENDER REGISTRATION). He explained that the bill was on the
Senate floor on April 29, 1993, where several amendments were
offered by a member of the minority, and it was then returned to
the Rules Committee. He directed attention to a proposed SCS CSHB
69(RLS) which he said deals with those questions in a way that is
agreeable to both the minority member and the sponsor of the
legislation.
Number 015
DOUG WOOLIVER, staff to Representative Ramona Barnes, voiced
Representative Barnes' support for the changes made in SCS CSHB
69(RLS). He then outlined the following differences in the two
versions of the bill:
(1) Page 2, line 12: The House version provides that the sex
offender shall register within seven days of release from a state
correctional facility. The Senate CS adds "in-state" before the
words "correctional facility." This addresses the concern that the
definition of "state correctional facility" is such that it doesn't
include contract jails, soft beds, etc.
(2) Page 2, paragraph (3): A sex offender who is serving a
sentence for a sex offense conviction in Alaska, but who serves
that sentence outside of the state, has to register after becoming
physically present in the state after release. The House version
provides the sex offender shall register within 14 days after
becoming physically present in the state, and the Senate version
changes that requirement to within seven days after becoming
physically present in the state.
(3) On page 3, line 13 of the Rules SCS a definition of
"correctional facility" was added that encompasses all the various
types of correctional facilities.
(4) On page 5, line 2 of the Rules SCS the fee for an
information request may not be greater than $10. The House version
provides that the fee may not be greater than $5.
(5) Effective dates in the applicability section (Section 12)
were changed from "January 1, 1994" in the House version to "July
1, 1994" in the Rules SCS.

SENATOR RIEGER moved that SCS CSHB 69(RLS) be adopted. Hearing no
objection, the motion carried.

There being no other witnesses present to testify on the changes
made in SCS CSHB 69(RLS), CHAIRMAN HALFORD asked for a calendaring
motion.
SENATOR RIEGER moved and asked unanimous consent that SCS CSHB
69(RLS) be approved for calendaring at the Chair's discretion.
Hearing no objection, it was so ordered.
There being no further business to come before the committee, the
meeting was adjourned at 1:59 p.m.
