HOUSE  BILL  NO. 47,  "An  Act  relating  to crime  and  criminal                                                               
procedure;  relating  to  generated obscene  child  sexual  abuse                                                               
material;  relating   to  the  powers  of   district  judges  and                                                               
magistrates; relating  to teaching certificates; and  relating to                                                               
licensing  of school  bus drivers."   [Before  the committee  was

REPRESENTATIVE  EISCHEID moved  to adopt  the proposed  committee                                                               
substitute  to CSHB  47(CRA),  Version  34-LS0334\G, C.  Radford,

REPRESENTATIVE VANCE,  as prime sponsor, stated  that the changes                                                               
in  Version G  are  recommendations from  the  Department of  Law                                                               
(DOL) to ensure that there are no  gaps in statute.  She said she                                                               
fully supports the changes as proposed.

DYLAN  HITCHCOCK-LOPEZ,  Staff,   Alaska  State  Legislature,  on                                                               
behalf of  Representative Gray, presented the  changes in Version                                                               
G  from  the written  explanation  of  changes [included  in  the                                                               
committee  file], which  read  as  follows [original  punctuation                                                               
provided]:                                                                                                                      
                                                                                                                                
     Section 3. Adds a new  section to amend AS 11.61.125(e)                                                                    
     to  provide  that  distribution  of  generated  obscene                                                                    
     child  sexual abuse  material under  AS 11.61.121  is a                                                                    
     qualifying  prior conviction  which enhances  the crime                                                                    
     of distribution  of child sexual abuse  material from a                                                                    
     class B to a class A felony.                                                                                               
                                                                                                                                
     Section  4.  Renumbered from  v.I  to  account for  the                                                                    
     addition of a new Section  3. Amends AS 11.61.127(a) to                                                                    
     clarify the  cross reference to AS  11.41.455(a) refers                                                                    
     specifically   to   the   conduct  enumerated   in   AS                                                                    
     11.41.455(a)(1)-(7).   Removes  language   regarding  a                                                                    
     "representation  that  is   indistinguishable  from  an                                                                    
     identifiable  child  under 18  years  of  age" from  AS                                                                    
     11.61.127(a)(2).                                                                                                           
                                                                                                                                
     Deleted.   Section  5   of   v.I,   which  amended   AS                                                                    
     11.61.127(f)  to  define  an "identifiable  child,"  is

KACI  SCHROEDER, Assistant  Attorney General,  Criminal Division,                                                               
Department  of  Law  (DOL),  agreed  with  Mr.  Hitchcock-Lopez's                                                               
explanation,  adding that  all  the changes  were  made with  the                                                               
intention   of  reducing   litigation,  rather   than  litigating                                                               
superfluous language.                                                                                                           
                                                                                                                                
CHAIR  GRAY  removed  his  objection.   There  being  no  further                                                               
objection, Version G was adopted.

REPRESENTATIVE COSTELLO reiterated her support for the bill.                                                                    
                                                                                                                                
REPRESENTATIVE  UNDERWOOD  expressed  support for  the  bill  and                                                               
emphasized the worthiness of protecting Alaskan children.                                                                       
                                                                                                                                
REPRESENTATIVE KOPP  added that  the bill  could have  a positive                                                               
impact on  reducing addiction  to this  type of  exploitation and                                                               
help stop repeated exposure.

REPRESENTATIVE  VANCE commented  on  the  pervasiveness of  child                                                               
sexual abuse material  (CSAM).  She said its time  to step up and                                                               
provide  protections  without  relying  on  federal  prosecution,                                                               
especially with the fast-paced  nature of artificial intelligence                                                               
(AI).   She explained  that the bill  would give  law enforcement                                                               
the tools to prosecute without  having to differentiate images of                                                               
real children from AI generated children, which would allow for                                                                 
faster prosecution to hold perpetrators accountable.

no  objection,  CSHB  47(JUD)  was  reported  out  of  the  House
