         Sec. 43.50.300. Excise tax levied. An excise tax is levied on                                                        
     tobacco products and electronic smoking products in the state. The                                                         
     tax is                                                                                                                     
              (1)  75 percent of the wholesale price of tobacco                                                                 
     products;                                                                                                              
             (2)  45 [25] percent of the wholesale price of                                                                
                   (A)  a closed-system electronic smoking product;                                                             
                   (B)  a vapor product sold as part of an open-system                                                          
         electronic smoking product;                                                                                            
                   (C)  a vapor product sold separately from a closed- or
