Full Journal pdf1997-05-11 House Journal Page 1854 SB 130 The following which had been held over from the May 10, 1997, supplemental calendar (page 1840), was read the second time: SENATE BILL NO. 130 "An Act amending the retirement incentive programs for municipalities and school districts; and providing for an effective date." 1997-05-11 House Journal Page 1855 SB 130 with the: Journal Page FIN RPT 4DP 1DNP 5NR 1851 SENATE ZERO FN (ADM) 4/29/97 1851 Representative Porter moved and asked unanimous consent that SB130 be considered engrossed, advanced to third reading and placed on final passage. There being no objection, it was so ordered. SB 130 was read the third time. The question being: "Shall SB 130 pass the House?" The roll was taken with the following result: SB 130 Third Reading Final Passage YEAS: 24 NAYS: 5 EXCUSED: 0 ABSENT: 11 Yeas: Austerman, Berkowitz, Brice, Bunde, Croft, Davis, Dyson, Elton, Green, Hodgins, Hudson, Ivan, James, Joule, Kemplen, Kookesh, Kott, Kubina, Masek, Nicholia, Phillips, Porter, Rokeberg, Williams Nays: Barnes, Cowdery, Ogan, Ryan, Vezey Absent: Davies, Foster, Grussendorf, Hanley, Kelly, Kohring, Martin, Moses, Mulder, Sanders, Therriault Barnes changed from "Yea" to "Nay". Ryan changed from "Yea" to "Nay". And so, SB 130 passed the House. Representative Porter moved the effective date clause. The question being: "Shall the effective date clause be adopted?" The roll was taken with the following result: 1997-05-11 House Journal Page 1856 SB 130 SB 130 Third Reading Effective Date YEAS: 21 NAYS: 8 EXCUSED: 0 ABSENT: 11 Yeas: Austerman, Berkowitz, Brice, Bunde, Croft, Dyson, Elton, Green, Hodgins, Hudson, Ivan, James, Joule, Kemplen, Kookesh, Kubina, Nicholia, Phillips, Porter, Rokeberg, Williams Nays: Barnes, Cowdery, Kott, Masek, Ogan, Ryan, Sanders, Vezey Absent: Davies, Davis, Foster, Grussendorf, Hanley, Kelly, Kohring, Martin, Moses, Mulder, Therriault Cowdery changed from "Yea" to "Nay". Kott changed from "Yea" to "Nay". And so, lacking the necessary 27 votes, the effective date clause was not adopted. SB 130(efd fld H) was signed by the Speaker and Chief Clerk and returned to the Senate.
