Full Journal pdf1994-02-24 Senate Journal Page 2960 SB 210 CS FOR SENATE BILL NO. 210(FIN) "An Act relating to disposals of state land within five miles of the right-of-way of the Dalton Highway to a licensed public utility or a licensed common carrier; relating to disposals of state land for nonresidential development in nodes of development along the Dalton Highway; and allowing state leases and materials sales for reconstruction and maintenance of state highways and construction or maintenance of airports" was read the third time. Senator Kerttula moved that CS FOR SENATE BILL NO. 210(FIN) be returned to second reading for the purpose of a specific amendment, that being Amendment No. 1. Senator Kelly objected, then withdrew his objection. There being no further objections, the bill was returned to second reading. Senators Kerttula, Sharp offered Amendment No. 1 : Page 1, line 4, following "Highway;": Insert "requiring licensed public utilities to pay the costs of change, relocation, or removal of a utility facility due to construction of a highway project;" 1994-02-24 Senate Journal Page 2961 SB 210 Page 2, following line 12: Insert a new bill section to read: "* Sec. 2. AS 19.40.200 is amended by adding a new subsection to read: (d) Notwithstanding another provision of law, when the department determines and orders that a utility facility located across, along, over, under, or within the highway right-of-way must be changed, relocated, or removed, the licensed public utility owning or maintaining the facility shall change, relocate, or remove it in accordance with the order and is responsible for the cost of the change, relocation, or removal." Senator Kerttula moved and asked unanimous consent for the adoption of Amendment No. 1. Senator Frank objected, then withdrew his objection. There being no further objections, Amendment No. 1 was adopted. CS FOR SENATE BILL NO. 210(FIN) am was automatically in third reading. Senator Lincoln moved that CS FOR SENATE BILL NO. 210(FIN) am be returned to second reading for the purpose of a specific amendment, that being Amendment No. 2. Objections were heard. The question being: "Shall CS FOR SENATE BILL NO. 210(FIN) am be returned to second reading for the purpose of a specific amendment?"
