00 CS FOR SENATE BILL NO. 243(RES) 01 "An Act relating to the board of directors of the Alaska Energy Authority; and 02 providing for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 44.83.030 is amended to read: 05 Sec. 44.83.030. Membership of the authority. The directors of the authority 06 [ALASKA ENERGY AUTHORITY] are 07 (1) the commissioner of revenue; 08 (2) the commissioner of commerce, community, and economic 09 development; and 10 (3) six public members appointed by the governor as follows: 11 (A) one member with expertise or experience in managing 12 or operating an electric utility that is not connected to an interconnected 13 electric energy transmission network as defined in AS 42.05.790; 14 (B) one member with expertise or experience in developing
01 energy projects in rural communities; 02 (C) one member with expertise or experience in managing 03 or operating an electric utility connected to an interconnected electric 04 energy transmission network as defined in AS 42.05.790; 05 (D) one member with financial expertise in large-scale 06 energy project development; and 07 (E) two members with expertise or experience in finance, 08 energy policy, energy technology, engineering, law, or economics [THE 09 MEMBERS OF THE ALASKA INDUSTRIAL DEVELOPMENT AND 10 EXPORT AUTHORITY]. 11 * Sec. 2. AS 44.83.030 is amended by adding new subsections to read: 12 (b) If the commissioner described in (a)(1) or (a)(2) of this section is unable to 13 attend a meeting of the authority, the commissioner may, by an instrument in writing 14 filed with the authority, designate a deputy or assistant to act in the commissioner's 15 place as a member at the meeting. For all purposes of this chapter, the designee is a 16 member of the authority at the meeting. 17 (c) Public members of the authority described in (a)(3) of this section serve for 18 three-year terms. 19 (d) If a vacancy occurs in the membership of the authority, the governor shall 20 immediately appoint a member for the unexpired portion of the term. 21 * Sec. 3. AS 44.83.040(a) is amended to read: 22 (a) The authority shall elect a chair and vice-chair every two years from 23 among its directors [OF THE ALASKA INDUSTRIAL DEVELOPMENT AND 24 EXPORT AUTHORITY SHALL SERVE AS OFFICERS OF THE ALASKA 25 ENERGY AUTHORITY]. The powers of the authority [ALASKA ENERGY 26 AUTHORITY] are vested in the directors, and five [FOUR] directors of the authority 27 constitute a quorum. Action may be taken and motions and resolutions adopted by the 28 authority [ALASKA ENERGY AUTHORITY] at a meeting by the affirmative vote 29 of at least five [A MAJORITY] of the directors. The directors of the authority 30 [ALASKA ENERGY AUTHORITY] serve without compensation, but they shall 31 receive the same travel pay and per diem as provided by law for board members under
01 AS 39.20.180. 02 * Sec. 4. The uncodified law of the State of Alaska is amended by adding a new section to 03 read: 04 TRANSITION. (a) The terms of the members of the board of directors of the Alaska 05 Energy Authority under AS 44.83.030, as that statute read before the effective date of this 06 Act, expire on the effective date of this Act. 07 (b) Notwithstanding AS 44.83.030(c), added by sec. 2 of this Act, public members of 08 the board of directors of the Alaska Energy Authority under AS 44.83.030(a)(3) are appointed 09 to initial terms as follows: 10 (1) the member appointed under AS 44.83.030(a)(3)(A), added by sec. 1 of 11 this Act, and one member appointed under AS 44.83.030(a)(3)(E), added by sec. 1 of this Act, 12 serve for terms that expire March 1, 2025; 13 (2) the member appointed under AS 44.83.030(a)(3)(B), added by sec. 1 of 14 this Act, and one member appointed under AS 44.83.030(a)(3)(E), added by sec. 1 of this Act, 15 serve for terms that expire March 1, 2026; 16 (3) the members appointed under AS 44.83.030(a)(3)(C) and (D), added by 17 sec. 1 of this Act, serve for terms that expire March 1, 2027. 18 (c) Nothing in this section prevents the appointment of a person whose term expires 19 under (a) of this section as a member of the board of directors of the Alaska Energy Authority 20 if the person meets the qualifications in AS 44.83.030, as amended by sec. 1 of this Act. 21 * Sec. 5. This Act takes effect July 1, 2024.
