01 "An Act relating to the workers' compensation benefits guaranty fund; and providing                                     
02 for an effective date."                                                                                                 
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
04    * Section 1. AS 23.30.082(a) is amended to read:                                                                   
05 (a)  The workers' compensation benefits guaranty fund is established as a                                           
06 separate fund in the state treasury [GENERAL FUND] to carry out the purposes of                                 
07 this section. The fund is composed of civil penalty payments made by employers                                          
08 under AS 23.30.080, income earned on investment of the money in the fund, money                                         
09 deposited in the fund by the department, and appropriations to the fund, if any.                                        
10       However, money appropriated to the fund does not lapse. Amounts in the fund may be                                
11       appropriated for claims against the fund, for expenses directly related to fund                                   
12       operations and claims, and for legal expenses.                                                                    
13    * Sec. 2. This Act takes effect immediately under AS 01.10.070(c).
