00 SENATE BILL NO. 153 01 "An Act exempting certain employees from overtime pay requirements; and providing 02 for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 23.10.060(d) is amended by adding a new paragraph to read: 05 (20) work performed by an employee of a facility licensed under 06 AS 47.32.010(b)(1), (4), (5), (6), (8), or (12) - (14) under a voluntary flexible work 07 hour plan if 08 (A) the employee and the employer have signed a written 09 agreement and the written agreement has been filed with the department; and 10 (B) the department has issued a certificate approving the plan 11 that states the work is for 40 hours a week and not more than 12 hours a day; 12 for work over 40 hours a week or 12 hours a day under a flexible work hour 13 plan not included as part of a collective bargaining agreement, compensation at 14 the rate of one and one-half times the regular rate of pay shall be paid for the
01 overtime. 02 * Sec. 2. This Act takes effect immediately under AS 01.10.070(c).
