00 HOUSE CS FOR CS FOR SENATE BILL NO. 95(RLS) 01 "An Act relating to special request specialty organization registration plates; relating to 02 special registration plates commemorating peace officers killed in the line of duty; 03 relating to special registration plates for vehicles owned by women veterans; relating to 04 special request registration plates for United States Space Force personnel; relating to 05 the transfer of vehicles; relating to commercial driver's licenses and commercial 06 instruction permits; and providing for an effective date." 07 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 08 * Section 1. AS 28.10.181 is amended by adding new subsections to read: 09 (ll) Special request specialty organization plates. The department shall adopt 10 regulations to allow for the issuance of special request specialty organization 11 registration plates sponsored by an organization that is based in this state and is tax 12 exempt under 26 U.S.C. 501(c)(2) - (11), 12(B) - (J), (13), (17) - (22), (24), or (26) - 13 (29), is an Alaska chapter of a national organization that is tax exempt under 26 U.S.C.

01 501(c)(2) - (11), 12(B) - (J), (13), (17) - (22), (24), or (26) - (29), is a department of 02 the state, or is a municipality of the state. The department shall determine a common 03 design and color for the plates and provide for the placement of the logo of the 04 organization and a short piece of descriptive text on the plate. If the department denies 05 an application to create a specialty organization registration plate under this section, 06 the department shall notify the commissioner of the denial. The commissioner may 07 reverse the decision of the department and require issuance of the requested plate. The 08 department may disapprove the issuance of registration plates under this subsection 09 when the requested plates duplicate an existing registration. Regulations adopted 10 under this subsection must 11 (1) provide that the entity requesting the issuance of the plates 12 (A) submit an application on a form provided by the 13 department; 14 (B) pay an application fee set by the department for issuance of 15 the new registration plates; 16 (C) pay the entire cost of developing and issuing the specialty 17 plate; 18 (D) may not be offensive in purpose, nature, activity, or name; 19 (E) may charge a fee for issuance of a specialty registration 20 plate in addition to any registration fees set by statute or regulation; 21 (2) provide for notice to the entity sponsoring the plate not later than 22 six months before a proposed cancellation of the specialty organization plate; 23 (3) establish procedures for owners of vehicles to purchase specialty 24 organization registration plates under this subsection. 25 (mm) Special request plates commemorating peace officers killed in the line 26 of duty. Upon application by the owner of a motor vehicle, the department may issue 27 registration plates commemorating peace officers killed in the line of duty. The 28 commissioner, after consulting with representatives of peace officers killed in the line 29 of duty, shall determine the design and color of the plates. The department may 30 disapprove the issuance of registration plates under this subsection when the requested 31 plates are a duplication of an existing registration. In this subsection, "peace officer"

01 means 02 (1) an officer of the state troopers; 03 (2) a member of the police force of a municipality; 04 (3) a correctional officer; 05 (4) a village public safety officer; 06 (5) an officer assigned to a court to serve warrants and court orders, 07 provide court security and judicial protection, and transport prisoners; and 08 (6) any other public servant vested by law with a duty to maintain 09 public order or to make arrests, whether the duty extends to all offenses or is limited to 10 a specific class of offenses or offenders. 11 (nn) Vehicles owned by women veterans. The department, upon receipt of 12 written proof that the woman veteran is a sole or joint owner of a motor vehicle, shall 13 issue special registration plates for the motor vehicle to a requesting person who is a 14 woman veteran or retired woman veteran of the armed forces of the United States. 15 (oo) Special request plates for United States Space Force personnel. Upon 16 application by the owner of a motor vehicle who presents satisfactory proof of current 17 membership in the Unites States Space Force, the department may design and issue 18 registration plates that identify the vehicle as registered to a member of the United 19 States Space Force. The department may disapprove the issuance of registration plates 20 under this subsection when the requested plates are a duplication of an existing 21 registration. 22 * Sec. 2. AS 28.10.421(d)(2) is amended to read: 23 (2) special request plates for 24 (A) Alaska National Guard or United States Space Force 25 personnel ...................................... $30; 26 (B) veterans, retired veterans, women veterans, retired 27 women veterans, or Lao veterans ...................... $30; 28 (C) recipients of the Purple Heart ........... none; 29 (D) recipients of the Bronze Star awarded for valor, Silver Star, 30 Navy Cross, Distinguished Service Cross, Air Force Cross, Coast Guard Cross, 31 or other award reflecting valor ........................ $30;

01 (E) owners of custom collector vehicles ........ $50; 02 (F) Iditarod race finishers ................. $50; 03 (G) other special request plates .............. $30; 04 plus the fee required for that vehicle under (b) of this section; the fee required by this 05 paragraph shall be collected only on the first issuance and on the replacement of 06 special request plates; 07 * Sec. 3. AS 28.10.421(d) is amended by adding new paragraphs to read: 08 (26) special request specialty organization plates under 09 AS 28.10.181(ll) ........................................ $100 10 plus the fee required for that vehicle under (b), (c), (h), or (i) of this section; the $100 11 fee required by this paragraph shall be collected only on the first issuance of and the 12 replacement of the plates; in addition, an entity sponsoring a special request specialty 13 organization plate may charge a fee on first issuance and renewal of the plates; 14 (27) special request plates commemorating peace officers killed in the 15 line of duty ........................................... $30 16 plus the fee required for that vehicle under (b), (c), (h), or (i) of this section; the fee 17 required by this paragraph shall be collected biennially in the same manner as the fee 18 required under (b), (c), (h), or (i) of this section. 19 * Sec. 4. AS 28.15.031(c) is amended to read: 20 (c) The department may not issue an original or duplicate commercial driver's 21 license to, nor renew or reinstate the commercial driver's license of, a person who is 22 disqualified from operating commercial motor vehicles in this or any other jurisdiction 23 [OR IS NOT DOMICILED IN THIS STATE]. 24 * Sec. 5. AS 28.15.051(f) is amended to read: 25 (f) A person who is at least 18 years of age may apply to the department for a 26 domiciled commercial instruction permit. The department may, after the applicant has 27 successfully passed all parts of the examination under AS 28.15.081 other than the 28 driving test, issue to the applicant a domiciled commercial instruction permit. The 29 permit allows a person, while having the permit in the person's immediate possession, 30 to drive a specified commercial type or class of motor vehicle on a highway or 31 vehicular way or area for a period not to exceed 180 days. The permittee shall be

01 accompanied by a person at least 21 years of age who has been licensed at least one 02 year to drive the type or class of vehicle being used, who is capable of exercising 03 control over the wheel, and who occupies a seat beside the driver. A domiciled 04 commercial instruction permit may be renewed one time for a period of 180 days. 05 Once a license is issued to drive a specified type or class of motor vehicle, a driver is 06 not eligible to obtain a domiciled commercial instruction [INSTRUCTIONAL] 07 permit for that specified type or class of motor vehicle unless 08 (1) five years have passed since the expiration of the previous license; 09 or 10 (2) the domiciled commercial instruction permit is obtained for the 11 purpose of adding an endorsement to a current class of commercial license. 12 * Sec. 6. AS 28.15.051 is amended by adding a new subsection to read: 13 (g) A person who is at least 18 years of age may apply to the department for a 14 non-domiciled commercial instruction permit. The department may, after the applicant 15 has successfully passed all parts of the examination under AS 28.15.081 other than the 16 driving test, issue to the applicant a non-domiciled commercial instruction permit if 17 the applicant is domiciled in a foreign jurisdiction or another state, the department 18 determines that the commercial motor vehicle testing and licensing standards of the 19 other jurisdiction meet the requirements of federal law, and the applicant satisfies the 20 requirements of AS 28.33.100(a)(2)(B) - (D). The permit allows a person, while 21 having the permit in the person's immediate possession, to drive a specified 22 commercial type or class of motor vehicle on a highway or vehicular way or area for a 23 period not to exceed one year. The permittee shall be accompanied by a person at least 24 21 years of age who has been licensed at least one year to drive the type or class of 25 vehicle being used, who is capable of exercising control over the wheel, and who 26 occupies a seat beside the driver. A non-domiciled commercial instruction permit must 27 be marked with "non-domiciled" on the face of the document. A non-domiciled 28 commercial instruction permit expires on the earlier of the expiration date determined 29 by the United States Department of Homeland Security that is stated on the form 30 required for the applicant under AS 28.33.100(a)(2)(B) or one year from the date of 31 issuance. Once a license is issued to drive a specified type or class of motor vehicle, a

01 driver is not eligible to obtain a non-domiciled commercial instruction permit for that 02 specified type or class of motor vehicle unless 03 (1) five years have passed since the expiration of the previous license; 04 or 05 (2) the non-domiciled commercial instruction permit is obtained for 06 the purpose of adding an endorsement to a current class of commercial license. 07 * Sec. 7. AS 28.22.031 is amended by adding a new subsection to read: 08 (c) The department shall review all accident reports and shall request proof of 09 insurance from a vehicle owner or operator in each case in which evidence of motor 10 vehicle liability insurance that complies with this chapter is not present. 11 * Sec. 8. AS 28.33.100(a) is amended to read: 12 (a) A person may not drive a commercial motor vehicle until the person 13 applies for and is issued a license for that purpose under AS 28.15.041. The 14 department may [NOT] issue a 15 (1) domiciled license to drive a commercial motor vehicle only if 16 [UNLESS] the applicant 17 (A) [(1)] is at least 18 years of age, to operate in intrastate 18 commerce, or at least 21 years of age, to operate in interstate commerce, 19 except as provided in (f) of this section; 20 (B) [(2)] has successfully completed all required driving tests 21 and written and physical examinations; 22 (C) [(3)] either does not have a driver's license issued by 23 another jurisdiction or surrenders all driver's licenses issued by other 24 jurisdictions; and 25 (D) [(4)] is domiciled in this state; 26 (2) non-domiciled license to drive a commercial motor vehicle if 27 the applicant 28 (A) is domiciled in 29 (i) a foreign jurisdiction that meets the requirements 30 set out in 49 C.F.R. 383.23(b)(1); or 31 (ii) another state that meets the requirements set out

01 in 49 C.F.R. 383.23(b)(2); and 02 (B) meets the applicable requirements set out in 03 AS 28.33.100(a) and 49 C.F.R. 383.71 04 (C) is at least 18 years of age, to operate in intrastate 05 commerce, or at least 21 years of age, to operate in interstate commerce, 06 except as provided in (f) of this section; and 07 (D) has successfully completed all required driving tests 08 and written and physical examinations. 09 * Sec. 9. AS 28.33.100 is amended by adding new subsections to read: 10 (g) A non-domiciled commercial driver's license must be marked with "non- 11 domiciled" on the face of the document. 12 (h) A non-domiciled commercial driver's license expires 13 (1) for an applicant under (a)(2)(A)(i) of this section, on the earlier of 14 (A) the expiration date determined by the United States 15 Department of Homeland Security that is stated on the form required for the 16 applicant under 49 C.F.R. 383.71(f)(2)(i); or 17 (B) one year from the date of issuance; 18 (2) for an applicant under (a)(2)(A)(ii) of this section, one year from 19 the date of issuance. 20 (i) In addition to the requirements under (a) of this 21 section, the holder of a non-domiciled commercial driver's license shall 22 notify the department of any adverse action taken by a foreign or 23 domestic jurisdiction or governmental agency against the person's 24 driving privileges as required by federal law. 25 * Sec. 10. AS 28.39.040(c) is amended to read: 26 (c) The department shall, upon assignment of a registration number, issue and 27 deliver to the owner a certificate of registration in a form prescribed by the 28 department. [A CERTIFICATE OF REGISTRATION IS NOT VALID UNLESS IT 29 IS SIGNED BY THE PERSON WHO SIGNED THE APPLICATION FOR 30 REGISTRATION.] 31 * Sec. 11. AS 28.39.050(a) is amended to read:

01 (a) If there is a change of ownership of a snowmobile, the [SELLER AND] 02 buyer shall [FILL OUT THE TRANSFER OF OWNERSHIP SECTION OF THE 03 REGISTRATION, AND THE SELLER SHALL SIGN OVER THE 04 REGISTRATION TO THE NEW OWNER. THE SELLER SHALL] promptly submit 05 an application for registration [THE TRANSFER OF OWNERSHIP SECTION] to 06 the department, and, if the application meets the requirements set out in this 07 chapter and in regulation, the department shall issue a new certificate of registration 08 to the new owner. 09 * Sec. 12. AS 28.90.990(a) is amended by adding new paragraphs to read: 10 (33) "commercial driver's license" includes a non-domiciled 11 commercial driver's license; 12 (34) "commercial learner's permit" includes a non-domiciled 13 commercial learner's permit. 14 * Sec. 13. AS 28.33.190(9) is repealed. 15 * Sec. 14. This Act takes effect immediately under AS 01.10.070(c).
