00 SENATE BILL NO. 81 am 01 "An Act relating to the office of victims' rights; and providing for an effective date." 02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 03 * Section 1. AS 24.65.020(b) is amended to read: 04 (b) The victims' advocate selection committee shall examine persons to serve 05 as victims' advocate regarding their qualifications and ability and shall place the name 06 of the person selected in nomination. The appointment is effective if the nomination is 07 ratified by two-thirds of the full membership of the senate and two-thirds of the 08 full membership of the house of representatives [APPROVED BY A ROLL CALL 09 VOTE OF TWO-THIRDS OF THE MEMBERS OF THE LEGISLATURE IN JOINT 10 SESSION]. The vote on the appointment shall be entered in the journals of both 11 houses. 12 * Sec. 2. AS 24.65.060 is amended to read: 13 Sec. 24.65.060. Compensation. The victims' advocate is entitled to receive an 14 annual salary of Range 26 on the salary schedule set out in AS 39.27.011(a) and (l) 15 [FOR JUNEAU].

01 * Sec. 3. AS 24.65.070(a) is amended to read: 02 (a) The victims' advocate shall appoint a person to serve as acting victims' 03 advocate in the absence of the victims' advocate. If the victims' advocate is not 04 available to appoint a person to serve as acting victims' advocate, the president of 05 the senate and the speaker of the house may jointly appoint an acting victims' 06 advocate. The victims' advocate shall also appoint assistants and clerical personnel 07 necessary to carry out the provisions of this chapter. Subject to AS 36.30.020, the 08 victims' advocate may enter into personal services and other contracts the victims' 09 advocate finds necessary to carry out the provisions of this chapter. The victims' 10 advocate shall, to the maximum extent practicable, conduct the duties and work of the 11 office by entering into personal services and other contracts the victims' advocate finds 12 necessary to carry out the provisions of this chapter. 13 * Sec. 4. AS 24.65.070(c) is amended to read: 14 (c) The victims' advocate and the staff appointed by the victims' advocate are 15 in the exempt service under AS 39.25.110 and are not subject to the employment 16 policies under AS 24.10 or AS 24.20. Staff appointed by the victims' advocate shall 17 (1) be compensated under the state salary schedule set out in 18 AS 39.27.011(a); or 19 (2) if the position requires admission to the practice of law in this 20 state as a condition of employment, be compensated under the state salary 21 schedule set out in AS 39.27.011(a) and (l). 22 * Sec. 5. This Act takes effect immediately under AS 01.10.070(c).
