00 SENATE BILL NO. 78 01 "An Act relating to hunting, trapping, and fishing licenses for certain nonresident 02 postsecondary students; and providing for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 16.05.340(k) is amended to read: 05 (k) In addition to the fees for a hunting license set out in (a), [AND] (d), and 06 (l) of this section, each person who purchases a hunting license shall pay an intensive 07 management surcharge as set out in this subsection for the purpose of providing 08 funding for the intensive management of the state's game populations under 09 AS 16.05.255(e). A person who is eligible for a $5 resident hunting, trapping, and 10 sport fishing license under (a)(6) of this section or a free license under AS 16.05.341 is 11 exempt from payment of the surcharge imposed under this subsection. The amount of 12 the surcharge attached to each hunting license must be clearly disclosed on the license. 13 Except as otherwise provided by this subsection, the intensive management surcharge 14 for each

01 (1) resident hunting license available under this section is $10; and 02 (2) nonresident hunting license available under this section is $30. 03 * Sec. 2. AS 16.05.340 is amended by adding a new subsection to read: 04 (l) An individual who is enrolled as a half-time student or full-time student at 05 a postsecondary institution described under AS 14.43.830(a) who does not qualify as a 06 resident under AS 16.05.415 may obtain a special nonresident postsecondary student 07 sport fishing, hunting, hunting and trapping, trapping, or hunting, trapping, and sport 08 fishing license by paying the fee provided in (a)(1) - (6) of this section for a resident 09 who has an annual family or household income above the most recent poverty 10 guidelines for the state set by the United States Department of Health and Human 11 Services. In this subsection, "half-time student" and "full-time student" have the 12 meanings given in AS 14.43.160. 13 * Sec. 3. The uncodified law of the State of Alaska is amended by adding a new section to 14 read: 15 TRANSITION: REGULATIONS. The Department of Fish and Game may adopt 16 regulations necessary to implement the changes made by this Act. The regulations take effect 17 under AS 44.62 (Administrative Procedure Act), but not before the effective date of the law 18 implemented by the regulation. 19 * Sec. 4. Section 3 of this Act takes effect immediately under AS 01.10.070(c). 20 * Sec. 5. Except as provided in sec. 4 of this Act, this Act takes effect January 1, 2024.
