00 SENATE BILL NO. 10 01 "An Act providing for trapping licenses for active members of the Alaska National 02 Guard and military reserves without charge; making sport fishing, hunting, and 03 trapping permanent identification cards available to certain disabled veterans without 04 charge; and providing for an effective date." 05 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 06 * Section 1. AS 16.05.340(a)(17) is amended to read: 07 (17) Waterfowl conservation tag .................... 10 08 (A) A person may not engage in waterfowl hunting without 09 having the current year's waterfowl tag in the person's actual possession, unless 10 that person 11 (i) qualifies for a $5 license fee under (6) of this 12 subsection; 13 (ii) is a resident under 18 years of age; 14 (iii) is 60 years of age or older and is a resident;

01 (iv) has an identification card issued [IS A 02 DISABLED VETERAN ELIGIBLE FOR A FREE LICENSE] under 03 AS 16.05.400(b) [AS 16.05.341]. 04 (B) The Board of Game shall by regulation exempt the 05 requirement of a waterfowl conservation tag for waterfowl hunting in areas of 06 the state not likely to benefit from programs described in AS 16.05.130(b)(2) - 07 (4). 08 * Sec. 2. AS 16.05.340(a)(23) is amended to read: 09 (23) Resident anadromous king salmon tag ............. 10 10 A resident may not engage in sport fishing for anadromous king salmon 11 without having the current year's anadromous king salmon tag in the resident's actual 12 possession, unless that person 13 (A) qualifies for a 50 cent license fee under (1) of this 14 subsection; 15 (B) is under 18 years of age; 16 (C) is 60 years of age or older and has been a resident of the 17 state for at least one year; 18 (D) has an identification card issued [IS A DISABLED 19 VETERAN ELIGIBLE FOR A FREE LICENSE] under AS 16.05.400(b) 20 [AS 16.05.341]; or 21 (E) qualifies for a $5 license fee under (6) of this subsection. 22 * Sec. 3. AS 16.05.341 is amended to read: 23 Sec. 16.05.341. Free license for [DISABLED VETERANS AND] active 24 members of the Alaska National Guard and military reserves. A person may 25 receive a resident hunting, trapping, and sport fishing license under 26 AS 16.05.340(a)(6) [AS 16.05.340(a)(5)] without charge if the person 27 [(1) HAS BEEN DISCHARGED FROM MILITARY SERVICE 28 UNDER HONORABLE CONDITIONS, IS ELIGIBLE FOR A LOAN UNDER 29 AS 18.56.101, AND IS CERTIFIED BY THE UNITED STATES DEPARTMENT 30 OF VETERANS AFFAIRS AS HAVING INCURRED A 50 PERCENT OR 31 GREATER DISABILITY DURING MILITARY SERVICE;

01 (2) SERVED IN THE ALASKA TERRITORIAL GUARD, IS 02 ELIGIBLE FOR A LOAN UNDER AS 18.56.101, AND INCURRED A 50 03 PERCENT OR GREATER DISABILITY WHILE SERVING IN THE ALASKA 04 TERRITORIAL GUARD; OR 05 (3)] is an active member of the 06 (1) [(A)] Alaska National Guard; 07 (2) [(B)] United States Army reserves; 08 (3) [(C)] United States Air Force reserves; 09 (4) [(D)] United States Navy reserves; 10 (5) [(E)] United States Marine Corps reserves; or 11 (6) [(F)] United States Coast Guard reserves. 12 * Sec. 4. AS 16.05.400(b) is amended to read: 13 (b) Upon request, and without charge, the commissioner shall issue a 14 permanent sport fishing, hunting, or trapping identification card to a resident who 15 completes the forms required by the commissioner for implementation of this 16 section and who 17 (1) is 60 years of age or older; 18 (2) has been discharged from military service under honorable 19 conditions, is eligible for a loan under AS 18.56.101, and is certified by the United 20 States Department of Veterans Affairs as having incurred a 50 percent or greater 21 disability during military service; or 22 (3) has served in the Alaska Territorial Guard, is eligible for a loan 23 under AS 18.56.101, and incurred a 50 percent or greater disability while serving 24 in the Alaska Territorial Guard. [THE COMMISSIONER SHALL ISSUE A 25 PERMANENT IDENTIFICATION CARD WITHOUT CHARGE TO A PERSON 26 WHO QUALIFIES BY AGE AND RESIDENCE AND WHO COMPLETES THE 27 FORMS REQUIRED BY THE COMMISSIONER FOR IMPLEMENTATION OF 28 THIS SUBSECTION. A PERSON WHO IS ISSUED A PERMANENT 29 IDENTIFICATION CARD UNDER THIS SUBSECTION MAY NOT SPORT FISH, 30 HUNT, OR TRAP WITHOUT HAVING A VALID IDENTIFICATION CARD 31 ISSUED UNDER THIS SUBSECTION OR THE APPROPRIATE LICENSE IN

01 POSSESSION.] 02 * Sec. 5. AS 16.05.400 is amended by adding a new subsection to read: 03 (c) A person who is issued a permanent identification card under this section 04 may not sport fish, hunt, or trap without having a valid identification card issued under 05 this section or the appropriate license in possession. 06 * Sec. 6. This Act takes effect January 1, 2024.
