00 HOUSE JOINT RESOLUTION NO. 22 01 Proposing an amendment to the Constitution of the State of Alaska relating to 02 subsistence use of replenishable natural resources by state residents; and providing for 03 an effective date for the amendment. 04 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. Article VIII, Constitution of the State of Alaska, is amended by adding a new 06 section to read: 07 Section 19. Subsistence Use of Replenishable Natural Resources. 08 Consistent with the sustained yield principle, the legislature may provide a preference 09 to and among residents of the State in the taking of a replenishable natural resource for 10 subsistence use based on customary and traditional use, direct dependence, the 11 availability of alternative resources, place of residence, or proximity to the resource. 12 When the harvestable surplus of a replenishable resource is insufficient to provide for 13 all beneficial uses, other beneficial uses shall be limited to protect subsistence uses of 14 the resource. 15 * Sec. 2. The amendment proposed by this resolution shall be placed before the voters of the

01 state at the next general election in conformity with art. XIII, sec. 1, Constitution of the State 02 of Alaska, and the election laws of the state. 03 * Sec. 3. If adopted by the voters at the next general election, the amendment proposed by 04 sec. 1 of this resolution takes effect immediately upon certification of the election returns by 05 the lieutenant governor.
