01 "An Act prohibiting certain restrictions based on the energy source of a motor vehicle."                                
02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
03    * Section 1. AS 28.90 is amended by adding a new section to article 1 to read:                                   
04 Sec. 28.90.050. Prohibition against certain restrictions based on the energy                                          
05 source of a motor vehicle. (a) A state agency or political subdivision may not restrict                               
06 the use or sale of a motor vehicle based on the energy source used by the motor                                         
07       vehicle.                                                                                                          
08            (b)  This section may not be construed to prohibit the regulation of motor                                   
09       vehicle emissions, including greenhouse gas emissions.                                                            
10 (c)  In this section, "energy source" means a source, including gasoline, diesel                                        
11 fuel, electricity, hydrogen, nuclear power, solar power, or a combination of sources,                                   
12 used to provide power to a motor vehicle for propulsion purposes or other functions of                                  
13       the motor vehicle.
