00 HOUSE BILL NO. 312 am 01 "An Act relating to the appointment of an assistant adjutant general; and providing for 02 an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 26.05.180(a) is amended to read: 05 (a) The headquarters of the Alaska National Guard is composed of an Army 06 National Guard component, an Air National Guard component, and a Naval Militia 07 component. The Army National Guard component and the Air National Guard 08 component shall each be commanded by an assistant adjutant general appointed by the 09 adjutant general with the concurrence of the governor. The adjutant general may, 10 when appointing an assistant adjutant general, give preference to a person who 11 has served at least five years in the Alaska Army National Guard or the Alaska 12 Air National Guard, or active duty service, or who has retired from active duty 13 service in the Army or Air Force within the preceding two years. An assistant 14 adjutant general shall, while holding office, have the grade of brigadier general or a

01 lower grade that the adjutant general may prescribe. On initial appointment, an 02 assistant adjutant general must hold , or have held, the rank of lieutenant colonel or 03 higher [A FEDERALLY-RECOGNIZED FIELD GRADE COMMISSION WITH AT 04 LEAST FIVE YEARS SERVICE IN THE ALASKA ARMY NATIONAL GUARD 05 OR IN THE ALASKA AIR NATIONAL GUARD]. 06 * Sec. 2. This Act takes effect immediately under AS 01.10.070(c).
