00 HOUSE BILL NO. 252 01 "An Act prohibiting certain transactions by or with foreign adversaries; and providing 02 for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 34 is amended by adding a new chapter to read: 05 Chapter 87. Prohibition on Transactions by Foreign Adversaries. 06 Sec. 34.87.010. Prohibition on transactions by foreign adversaries. (a) A 07 foreign adversary may not 08 (1) buy, lease, or rent critical infrastructure, land used for agricultural 09 production, or real property that has a direct line of sight to any part of a military 10 installation in the state; or 11 (2) enter into a contract with a person that would result in the foreign 12 adversary's control of critical infrastructure or land used for agricultural production in 13 the state. 14 (b) A foreign adversary that violates this section shall divest itself of its
01 interest in critical infrastructure or land used for agricultural production in the state 02 within one year, after which time the property may be sold at public auction by the 03 municipality in which the critical infrastructure or land is located, or by the state if the 04 critical infrastructure or land is located in the unorganized borough. 05 (c) The attorney general or the municipality where the critical infrastructure or 06 land used for agricultural production is located may bring an action in the superior 07 court to enjoin a person from violating the provisions of this section. 08 Sec. 34.87.900. Definitions. In this chapter, 09 (1) "critical infrastructure" means systems and assets, whether physical 10 or virtual, so vital to the United States that the incapacity or destruction of the systems 11 and assets would have a debilitating effect on security, national economic security, 12 national public health or safety, or any combination of those matters; 13 (2) "foreign adversary" means a citizen of, a corporation domiciled or 14 headquartered in, or the government of the People's Republic of China, the Republic 15 of Cuba, the Islamic Republic of Iran, the Democratic People's Republic of Korea, the 16 Russian Federation, the Syrian Arab Republic, the Republic of Yemen, or the 17 Bolivarian Republic of Venezuela or a corporation in which a citizen of the People's 18 Republic of China, the Republic of Cuba, the Islamic Republic of Iran, the Democratic 19 People's Republic of Korea, the Russian Federation, the Syrian Arab Republic, the 20 Republic of Yemen, or the Bolivarian Republic of Venezuela has a controlling 21 interest. 22 * Sec. 2. The uncodified law of the State of Alaska is amended by adding a new section to 23 read: 24 APPLICABILITY: CONTRACTS. AS 34.87.010 and 34.87.900, enacted by sec. 1 of 25 this Act, applies to contracts entered into on or after the effective date of this Act. 26 * Sec. 3. This Act takes effect immediately under AS 01.10.070(c).
