00 SENATE CS FOR HOUSE BILL NO. 120(FIN) am S 01 "An Act relating to hunting, trapping, and fishing licenses for certain nonresident 02 postsecondary students; relating to animal adoption and foster care records; and 03 providing for an effective date." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. AS 16.05.340(k) is amended to read: 06 (k) In addition to the fees for a hunting license set out in (a), [AND] (d), and 07 (l) of this section, each person who purchases a hunting license shall pay an intensive 08 management surcharge as set out in this subsection for the purpose of providing 09 funding for the intensive management of the state's game populations under 10 AS 16.05.255(e). A person who is eligible for a $5 resident hunting, trapping, and 11 sport fishing license under (a)(6) of this section or a free license under AS 16.05.341 is 12 exempt from payment of the surcharge imposed under this subsection. The amount of 13 the surcharge attached to each hunting license must be clearly disclosed on the license. 14 Except as otherwise provided by this subsection, the intensive management surcharge
01 for each 02 (1) resident hunting license available under this section is $10; and 03 (2) nonresident hunting license available under this section is $30. 04 * Sec. 2. AS 16.05.340 is amended by adding new subsections to read: 05 (l) A nonresident or nonresident alien who is enrolled as a half-time student or 06 full-time student at a postsecondary institution described in AS 14.43.830(a) may 07 obtain a special nonresident and nonresident alien postsecondary student sport fishing, 08 hunting, hunting and trapping, trapping, or hunting, trapping, and sport fishing license 09 (1) if under 60 years of age, by paying the fee provided in (a)(1) - (6) 10 of this section for a resident who has an annual family or household income above the 11 most recent poverty guidelines for the state set by the United States Department of 12 Health and Human Services; or 13 (2) if 60 years of age or over, by applying to the department without 14 charge for the license. 15 (m) In this section, "half-time student" and "full-time student" have the 16 meanings given in AS 14.43.160. 17 * Sec. 3. AS 40.25.120(a) is amended to read: 18 (a) Every person has a right to inspect a public record in the state, including 19 public records in recorders' offices, except 20 (1) records of vital statistics and adoption proceedings, which shall be 21 treated in the manner required by AS 18.50; 22 (2) records pertaining to juveniles unless disclosure is authorized by 23 law; 24 (3) medical and related public health records; 25 (4) records required to be kept confidential by a federal law or 26 regulation or by state law; 27 (5) to the extent the records are required to be kept confidential under 28 20 U.S.C. 1232g and the regulations adopted under 20 U.S.C. 1232g in order to secure 29 or retain federal assistance; 30 (6) records or information compiled for law enforcement purposes, but 31 only to the extent that the production of the law enforcement records or information
01 (A) could reasonably be expected to interfere with enforcement 02 proceedings; 03 (B) would deprive a person of a right to a fair trial or an 04 impartial adjudication; 05 (C) could reasonably be expected to constitute an unwarranted 06 invasion of the personal privacy of a suspect, defendant, victim, or witness; 07 (D) could reasonably be expected to disclose the identity of a 08 confidential source; 09 (E) would disclose confidential techniques and procedures for 10 law enforcement investigations or prosecutions; 11 (F) would disclose guidelines for law enforcement 12 investigations or prosecutions if the disclosure could reasonably be expected to 13 risk circumvention of the law; or 14 (G) could reasonably be expected to endanger the life or 15 physical safety of an individual; 16 (7) names, addresses, and other information identifying a person as a 17 participant in the Education Trust of Alaska under AS 14.40.802 or the advance 18 college tuition savings program under AS 14.40.803 - 14.40.817; 19 (8) public records containing information that would disclose or might 20 lead to the disclosure of a component in the process used to execute or adopt an 21 electronic signature if the disclosure would or might cause the electronic signature to 22 cease being under the sole control of the person using it; 23 (9) reports submitted under AS 05.25.030 concerning certain 24 collisions, accidents, or other casualties involving boats; 25 (10) records or information pertaining to a plan, program, or 26 procedures for establishing, maintaining, or restoring security in the state, or to a 27 detailed description or evaluation of systems, facilities, or infrastructure in the state, 28 but only to the extent that the production of the records or information 29 (A) could reasonably be expected to interfere with the 30 implementation or enforcement of the security plan, program, or procedures; 31 (B) would disclose confidential guidelines for investigations or
01 enforcement and the disclosure could reasonably be expected to risk 02 circumvention of the law; or 03 (C) could reasonably be expected to endanger the life or 04 physical safety of an individual or to present a real and substantial risk to the 05 public health and welfare; 06 (11) [REPEALED 07 (12)] records that are 08 (A) proprietary, privileged, or a trade secret in accordance with 09 AS 43.90.150 or 43.90.220(e); 10 (B) applications that are received under AS 43.90 until notice is 11 published under AS 43.90.160; 12 (12) [(13)] information of the Alaska Gasline Development 13 Corporation created under AS 31.25.010 or a subsidiary of the Alaska Gasline 14 Development Corporation that is confidential by law or under a valid confidentiality 15 agreement; 16 (13) [(14)] information under AS 38.05.020(b)(11) that is subject to a 17 confidentiality agreement under AS 38.05.020(b)(12); 18 (14) [(15)] records relating to proceedings under AS 09.58 (Alaska 19 Medical Assistance False Claim and Reporting Act); 20 (15) [(16)] names, addresses, and other information identifying a 21 person as a participant in the Alaska savings program for eligible individuals under 22 AS 06.65; 23 (16) [(17)] artists' submissions made in response to an inquiry or 24 solicitation initiated by the Alaska State Council on the Arts under AS 44.27.060; 25 (17) [(18)] records that are 26 (A) investigative files under AS 45.55.910; or 27 (B) confidential under AS 45.56.620; 28 (18) names, addresses, or other information identifying a person as adopting or 29 providing foster care for an animal. 30 * Sec. 4. The uncodified law of the State of Alaska is amended by adding a new section to 31 read:
01 TRANSITION: REGULATIONS. The Department of Fish and Game may adopt 02 regulations necessary to implement the changes made by secs. 1 and 2 of this Act. The 03 regulations take effect under AS 44.62 (Administrative Procedure Act), but not before the 04 effective date of the law implemented by the regulation. 05 * Sec. 5. Section 4 of this Act takes effect immediately under AS 01.10.070(c). 06 * Sec. 6. Sections 1 and 2 of this Act take effect January 1, 2025.
