00 CS FOR HOUSE BILL NO. 29(L&C) 01 "An Act relating to insurance discrimination." 02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 03 * Section 1. AS 21.36 is amended by adding a new section to read: 04 Sec. 21.36.520. Discrimination based on political party or elected official 05 status. (a) A person transacting insurance in this state may not, solely because of a 06 person's political party or a person's status as an elected official, 07 (1) refuse to issue or renew insurance coverage; 08 (2) limit the scope of insurance coverage; 09 (3) cancel an existing policy of insurance; 10 (4) deny a covered claim; or 11 (5) increase the premium, policy fees, or rates charged on an insurance 12 policy. 13 (b) The provisions of (a) of this section do not apply if the refusal, limitation, 14 cancellation, denial, or increase is 15 (1) based on sound underwriting or actuarial principles reasonably

01 related to actual or anticipated loss experience; or 02 (2) required or authorized by law or regulation. 03 (c) In this section, 04 (1) "elected official" means a member of the legislature, the governor, 05 the lieutenant governor, a constitutional convention delegate, a borough or city mayor, 06 or a member of a borough or city assembly, council, or school board; 07 (2) "political party" has the meaning given in AS 15.80.010. 08 * Sec. 2. The uncodified law of the State of Alaska is amended by adding a new section to 09 read: 10 APPLICABILITY. This Act applies to an insurance policy or contract issued, 11 delivered, or renewed on or after the effective date of this Act.
