00                 SPONSOR SUBSTITUTE FOR HOUSE BILL NO. 11                                                               
01 "An Act establishing the crime of assault in the presence of a child."                                                  
02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
03    * Section 1. AS 11.41 is amended by adding a new section to read:                                                  
04 Sec. 11.41.240. Assault in the presence of a child. (a) A person commits the                                          
05 crime of assault in the presence of a child if the person commits an assault under                                      
06 AS 11.41.200 - 11.41.230 with reckless disregard that, at the time of the assault, a                                    
07 child under 16 years of age is present in the dwelling, vehicle, or location where the                                  
08       assault occurs.                                                                                                   
09            (b)  In this section, "present" means physically present or within hearing of the                            
10       assault.                                                                                                          
11            (c)  Assault in the presence of a child is a class A misdemeanor.
