01 "An Act establishing the crime of assault in the presence of a child."                                                  
02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
03    * Section 1. AS 11.41 is amended by adding a new section to read:                                                  
04 Sec. 11.41.240. Assault in the presence of a child. (a) A person commits the                                          
05 crime of assault in the presence of a child if the person commits an assault under                                      
06 AS 11.41.200 - 11.41.230 with reckless disregard that, at the time of the assault, a                                    
07 child under 16 years of age is present in the dwelling, vehicle, or location where the                                  
08       assault occurs.                                                                                                   
09            (b)  Assault in the presence of a child is a class A misdemeanor.                                            
10    * Sec. 2. The uncodified law of the State of Alaska is amended by adding a new section to                          
11 read:                                                                                                                   
12       APPLICABILITY. AS 11.41.240, enacted by sec. 1 of this Act, applies to offenses                                   
13 committed on or after the effective date of this Act.
