00 SENATE BILL NO. 221 01 "An Act relating to appropriations of federal receipts; and relating to an increase of an 02 appropriation based on additional federal receipts." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 37.07.080(h) is amended to read: 05 (h) The legislature may provide for a specific maximum percentage 06 increase of an appropriation item in an appropriation bill based on potential 07 additional federal receipts. If the legislature provides for a specific maximum 08 percentage increase of an appropriation item in an appropriation bill based on 09 potential additional federal receipts, the [THE] increase of the [AN] appropriation 10 item [BASED ON ADDITIONAL FEDERAL OR OTHER PROGRAM RECEIPTS 11 NOT SPECIFICALLY APPROPRIATED BY THE FULL LEGISLATURE] may be 12 expended only in accordance with the following procedures: 13 (1) the governor shall submit a revised program to the Legislative 14 Budget and Audit Committee for review; the revised program must contain a

01 declaration by the governor that states the revised program does not exceed the 02 specific maximum percentage increase of the appropriation item in the applicable 03 appropriation bill; 04 (2) the Legislative Budget and Audit Committee shall review the 05 revised program to ensure the program does not exceed the specific maximum 06 percentage increase of the appropriation item in the applicable appropriation 07 bill; 08 (3) the Legislative Budget and Audit Committee may recommend 09 to the governor an alternative allocation for expenditures under the revised 10 program; 11 (4) if the Legislative Budget and Audit Committee makes a 12 recommendation to correct or otherwise change a revised program, the governor 13 may submit a corrected or otherwise updated revised program to the Legislative 14 Budget and Audit Committee for review; the corrected or otherwise updated 15 revised program must contain a declaration by the governor that states the 16 corrected or otherwise updated revised program does not exceed the specific 17 maximum percentage increase of the appropriation item in the applicable 18 appropriation bill; 19 (5) 45 days shall elapse before commencement of expenditures under 20 the revised program unless the Legislative Budget and Audit Committee earlier 21 recommends that the state take part in the federally [OR OTHERWISE] funded 22 activity [; 23 (3) SHOULD THE LEGISLATIVE BUDGET AND AUDIT 24 COMMITTEE RECOMMEND WITHIN THE 45-DAY PERIOD THAT THE 25 STATE NOT INITIATE THE ADDITIONAL ACTIVITY, THE GOVERNOR 26 SHALL AGAIN REVIEW THE REVISED PROGRAM AND IF THE GOVERNOR 27 DETERMINES TO AUTHORIZE THE EXPENDITURE, THE GOVERNOR 28 SHALL PROVIDE THE LEGISLATIVE BUDGET AND AUDIT COMMITTEE 29 WITH A STATEMENT OF THE GOVERNOR'S REASONS BEFORE 30 COMMENCEMENT OF EXPENDITURES UNDER THE REVISED PROGRAM]. 31 * Sec. 2. AS 37.07.080 is amended by adding a new subsection to read:

01 (i) When the legislature is not in session, the governor or legislature may call a 02 special session under AS 24.05.100 to appropriate additional federal receipts that 03 exceed the specific maximum percentage increase the legislature has provided for 04 under (h) of this section, or other federal receipts for an item, program, or project not 05 specifically appropriated by the legislature. 06 * Sec. 3. The uncodified law of the State of Alaska is amended by adding a new section to 07 read: 08 APPLICABILITY. This Act does not apply to appropriations that were increased 09 before the effective date of this Act based on compliance with AS 37.07.080(h), as that 10 section read before the effective date of this Act.
