01 "An Act relating to exemptions from minimum wage."                                                                      
02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
03    * Section 1. AS 23.10.070 is amended to read:                                                                        
04 Sec. 23.10.070. Exemptions from minimum wage. To the extent necessary to                                                
05 prevent curtailment of opportunities of employment, the commissioner may by                                             
06 regulations or orders provide for the employment at wages lower than the minimum                                        
07       wage prescribed in AS 23.10.050 - 23.10.150 of                                                                    
08                 (1)  [AN INDIVIDUAL WHOSE EARNING CAPACITY IS                                                           
09       IMPAIRED BY PHYSICAL OR MENTAL DEFICIENCY, AGE, OR INJURY, AT                                                     
10       THE WAGES AND SUBJECT TO THE RESTRICTIONS AND FOR THE PERIOD                                                      
11       OF TIME THAT ARE FIXED BY THE COMMISSIONER; AND                                                                   
12                 (2)]  an apprentice at the wages that are approved by the commissioner;                                 
13                 (2)  [OR (3)] a learner at the wages and subject to the restrictions and                              
14       for the periods of time that are fixed by the commissioner; or                                                  
15                 (3)  an individual employed by a nonprofit organization for not                                       

01       more than 12 weeks in a calendar year at a residential summer camp who                                          
02       receives room and board in addition to a weekly wage that is equal to or greater                                
03       than                                                                                                            
04                      (A)  80 percent of the minimum hourly wage established                                           
05            under AS 23.10.065(a), multiplied by 40 hours; or                                                          
06                      (B)  50 percent of the minimum wage established under                                            
07            AS 23.10.065(a) multiplied by the total hours worked in the week by the                                    
08            individual.
