00 SENATE BILL NO. 145 01 "An Act relating to per diem for legislators; and providing for an effective date." 02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 03 * Section 1. AS 24.10.130(b) is amended to read: 04 (b) Legislators and officers and employees of the legislative branch of 05 government may be entitled to a per diem allowance; however, if a bill that fully funds 06 an operating budget has not, within the first 121 consecutive days of a regular 07 legislative session, including the day the legislature first convenes in that regular 08 session, been passed by the legislature, a member of the legislature may not receive 09 [IS NOT ENTITLED TO] a daily per diem allowance for the period beginning the 10 day after the 121st day of that regular session and ending [A DAY THE 11 LEGISLATURE IS IN SESSION AFTER THAT 121-DAY PERIOD UNTIL] the 12 first day after a bill that fully funds an operating budget is passed by the legislature or 13 the first day of the next regular legislative session, whichever occurs earlier. If a bill 14 that fully funds an operating budget is not passed by the legislature within the 15 first 121 consecutive days of a regular legislative session, daily per diem may not

01 be retroactively authorized for the period beginning the day after the 121st day 02 of that regular session and ending the first day after a bill that fully funds an 03 operating budget is passed by the legislature. In this subsection, "passed by the 04 legislature" has the meaning given in AS 01.10.070. 05 * Sec. 2. This Act takes effect immediately under AS 01.10.070(c).
