01 "An Act relating to the sovereignty of state elections."                                                                
02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
03    * Section 1. AS 15.80 is amended by adding a new section to read:                                                  
04 Sec. 15.80.001. Sovereignty of state elections. (a) Notwithstanding any other                                         
05 provision of law, if the federal government enacts a measure that significantly affects                                 
06 a rule, practice, or procedure or that requires the state to register voters or conduct its                             
07 elections in a manner that the director determines is inconsistent with a provision of or                               
08       regulation adopted under AS 15, the division shall                                                                
09                 (1)  stop administering elections for electors of the President and Vice                                
10       President of the United States and for members of the United States Congress; and                                 
11                 (2)  continue to conduct all other elections for which the division is                                  
12       responsible in accordance with state law.                                                                         
13            (b)  If the division stops administering elections for federal offices under (a) of                          
14       this section,                                                                                                     
15                 (1)  an agency, employee, or agent of the state or a municipality may                                   

01       not expend funds to adopt or enforce the implementation of the federal measure that                               
02       the director has determined is inconsistent with a provision of or regulation adopted                             
03       under AS 15; and                                                                                                  
04                 (2)  the federal government may administer its own elections for federal                                
05       offices in the state.
