00 CS FOR SENATE BILL NO. 119(STA) 01 "An Act relating to oaths of office; and requiring public officers to read the state 02 constitution, the Declaration of Independence, and the United States Constitution." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 14.12.090 is amended to read: 05 Sec. 14.12.090. Oath. School board members, before taking office, shall read 06 the Constitution of the State of Alaska, the Declaration of Independence, and the 07 Constitution of the United States and shall take, [AND] sign, and file with the 08 applicable school board the following oath or affirmation: "I do solemnly swear (or 09 affirm) that I will support and defend the Constitution of the United States and the 10 Constitution of the State of Alaska and that I will honestly, faithfully, and impartially 11 discharge my duties as a school board member to the best of my ability." 12 * Sec. 2. AS 18.65.010(c) is amended to read: 13 (c) Each special officer shall carry identification issued by the commissioner 14 of public safety and shall carry firearms in the manner the commissioner of public

01 safety requires. Each person appointed shall, after reading the Constitution of the 02 State of Alaska, the Declaration of Independence, and the Constitution of the 03 United States, take, sign, and file with the division in the Department of 04 Education and Early Development responsible for state libraries, archives, and 05 museums the constitutional oath of office. Persons appointed may hold other public or 06 private employment. 07 * Sec. 3. AS 22.05.090 is amended to read: 08 Sec. 22.05.090. Oath of office. Each supreme court justice, upon entering 09 office, shall, after reading the Constitution of the State of Alaska, the Declaration 10 of Independence, and the Constitution of the United States, take, sign, and file 11 with the division in the Department of Education and Early Development 12 responsible for state libraries, archives, and museums [AND SUBSCRIBE TO] an 13 oath of office required of all officers under the constitution and any further oath or 14 affirmation that may be prescribed by law. 15 * Sec. 4. AS 22.07.050 is amended to read: 16 Sec. 22.07.050. Oath of office. Each judge of the court of appeals, upon 17 entering office, shall, after reading the Constitution of the State of Alaska, the 18 Declaration of Independence, and the Constitution of the United States, take, 19 sign, and file with the division in the Department of Education and Early 20 Development responsible for state libraries, archives, and museums [AND 21 SUBSCRIBE TO] the oath or affirmation of office required of all officers under the 22 constitution. 23 * Sec. 5. AS 22.10.110 is amended to read: 24 Sec. 22.10.110. Oath of office. Each superior court judge, upon entering 25 office, shall, after reading the Constitution of the State of Alaska, the Declaration 26 of Independence, and the Constitution of the United States, take, sign, and file 27 with the division in the Department of Education and Early Development 28 responsible for state libraries, archives, and museums [AND SUBSCRIBE TO] an 29 oath of office required of all officers under the constitution and any further oath or 30 affirmation as may be prescribed by law. 31 * Sec. 6. AS 22.15.180 is amended to read:

01 Sec. 22.15.180. Oath of office. Each district judge and magistrate, upon 02 entering office, shall, after reading the Constitution of the State of Alaska, the 03 Declaration of Independence, and the Constitution of the United States, take, 04 sign, and file with the division in the Department of Education and Early 05 Development responsible for state libraries, archives, and museums [AND 06 SUBSCRIBE TO] an oath of office required of all officers under the constitution and 07 any further oath or affirmation that may be prescribed by law. 08 * Sec. 7. AS 24.05.060 is amended to read: 09 Sec. 24.05.060. Disqualifications. A person is not qualified for membership in 10 the legislature who is disqualified to hold public office under the provisions of art. 11 XII, sec. 4, Constitution of the State of Alaska, and as it may be implemented by law. 12 Each member of the legislature, before entering upon the duties of the office, shall, 13 after reading the Constitution of the State of Alaska, the Declaration of 14 Independence, and the Constitution of the United States, take, sign, and file with 15 the division in the Department of Education and Early Development responsible 16 for state libraries, archives, and museums the oath of office prescribed in art. XII, 17 sec. 5, Constitution of the State of Alaska, and such further oath or affirmation 18 prescribed by law for members of the legislature or other officers of the state. 19 * Sec. 8. AS 29.20.600 is amended to read: 20 Sec. 29.20.600. Oaths of office. Before taking office a municipal official shall, 21 after reading the Constitution of the State of Alaska, the Declaration of 22 Independence, and the Constitution of the United States, affirm in writing that the 23 duties of the office will be honestly, faithfully, and impartially performed by the 24 official. The oath is filed with the municipal clerk. 25 * Sec. 9. AS 39.05.040 is amended to read: 26 Sec. 39.05.040. Oaths for executive officers, boards. The principal executive 27 officer of each department and the member of each board within the state government 28 shall, after reading the Constitution of the State of Alaska, the Declaration of 29 Independence, and the Constitution of the United States, take, sign, and file with 30 the division in the Department of Education and Early Development responsible 31 for state libraries, archives, and museums the oath of office required by the

01 constitution before entering upon the duties of office. 02 * Sec. 10. AS 39.05.045 is amended to read: 03 Sec. 39.05.045. Oaths for other employees. A public officer or employee of 04 the state, before entering upon the duties of office, shall read the Constitution of the 05 State of Alaska, the Declaration of Independence, and the Constitution of the 06 United States and take, [AND] sign, and file with the division in the Department 07 of Education and Early Development responsible for state libraries, archives, and 08 museums the following oath or affirmation: "I do solemnly swear (or affirm) that I 09 will support and defend the Constitution of the United States and the Constitution of 10 the State of Alaska, and that I will faithfully discharge my duties as . . . . . . . . . . . . . . . 11 to the best of my ability."
