00 CS FOR SENATE BILL NO. 119(JUD) 01 "An Act relating to oaths of office; and requiring public officers to read the state 02 constitution and the United States Constitution." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 14.12.090 is amended to read: 05 Sec. 14.12.090. Oath. School board members, before taking office, shall read 06 the Constitution of the State of Alaska and the Constitution of the United States 07 and take and sign the following oath or affirmation: "I do solemnly swear (or affirm) 08 that I will support and defend the Constitution of the United States and the 09 Constitution of the State of Alaska and that I will honestly, faithfully, and impartially 10 discharge my duties as a school board member to the best of my ability." 11 * Sec. 2. AS 18.65.010(c) is amended to read: 12 (c) Each special officer shall carry identification issued by the commissioner 13 of public safety and shall carry firearms in the manner the commissioner of public 14 safety requires. Each person appointed shall, after reading the Constitution of the

01 State of Alaska and the Constitution of the United States, take the constitutional 02 oath of office. Persons appointed may hold other public or private employment. 03 * Sec. 3. AS 22.05.090 is amended to read: 04 Sec. 22.05.090. Oath of office. Each supreme court justice, upon entering 05 office, shall, after reading the Constitution of the State of Alaska and the 06 Constitution of the United States, take and subscribe to an oath of office required of 07 all officers under the constitution and any further oath or affirmation that may be 08 prescribed by law. 09 * Sec. 4. AS 22.07.050 is amended to read: 10 Sec. 22.07.050. Oath of office. Each judge of the court of appeals, upon 11 entering office, shall, after reading the Constitution of the State of Alaska and the 12 Constitution of the United States, take and subscribe to the oath or affirmation of 13 office required of all officers under the constitution. 14 * Sec. 5. AS 22.10.110 is amended to read: 15 Sec. 22.10.110. Oath of office. Each superior court judge, upon entering 16 office, shall, after reading the Constitution of the State of Alaska and the 17 Constitution of the United States, take and subscribe to an oath of office required of 18 all officers under the constitution and any further oath or affirmation as may be 19 prescribed by law. 20 * Sec. 6. AS 22.15.180 is amended to read: 21 Sec. 22.15.180. Oath of office. Each district judge and magistrate, upon 22 entering office, shall, after reading the Constitution of the State of Alaska and the 23 Constitution of the United States, take and subscribe to an oath of office required of 24 all officers under the constitution and any further oath or affirmation that may be 25 prescribed by law. 26 * Sec. 7. AS 24.05.060 is amended to read: 27 Sec. 24.05.060. Disqualifications. A person is not qualified for membership in 28 the legislature who is disqualified to hold public office under the provisions of art. 29 XII, sec. 4, Constitution of the State of Alaska, and as it may be implemented by law. 30 Each member of the legislature, before entering upon the duties of the office, shall, 31 after reading the Constitution of the State of Alaska and the Constitution of the

01 United States, take the oath of office prescribed in art. XII, sec. 5, Constitution of the 02 State of Alaska, and such further oath or affirmation prescribed by law for members of 03 the legislature or other officers of the state. 04 * Sec. 8. AS 29.20.600 is amended to read: 05 Sec. 29.20.600. Oaths of office. Before taking office a municipal official shall, 06 after reading the Constitution of the State of Alaska and the Constitution of the 07 United States, affirm in writing that the duties of the office will be honestly, 08 faithfully, and impartially performed by the official. The oath is filed with the 09 municipal clerk. 10 * Sec. 9. AS 39.05.040 is amended to read: 11 Sec. 39.05.040. Oaths for executive officers, boards. The principal executive 12 officer of each department and the member of each board within the state government 13 shall, after reading the Constitution of the State of Alaska and the Constitution of 14 the United States, take, sign, and file the oath of office required by the constitution 15 before entering upon the duties of office. 16 * Sec. 10. AS 39.05.045 is amended to read: 17 Sec. 39.05.045. Oaths for other employees. A public officer or employee of 18 the state, before entering upon the duties of office, shall read the Constitution of the 19 State of Alaska and the Constitution of the United States and take and sign the 20 following oath or affirmation: "I do solemnly swear (or affirm) that I will support and 21 defend the Constitution of the United States and the Constitution of the State of 22 Alaska, and that I will faithfully discharge my duties as . . . . . . . . . . . . . . . to the best 23 of my ability."
