00 SENATE BILL NO. 69 am 01 "An Act extending an exemption from regulation as a public utility for plants and 02 facilities generating electricity entirely from renewable energy resources; and providing 03 for an effective date." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. AS 42.05.711(r) is amended to read: 06 (r) A plant or facility that generates electricity entirely from renewable energy 07 resources is exempt from regulation under this chapter, other than applicable 08 regulation under AS 42.05.760 - 42.05.790, if 09 (1) the plant or facility 10 (A) is first placed into commercial operation on or after 11 August 31, 2010, and before July 1, 2028 [2021]; and 12 (B) does not generate more than 65 megawatts of electricity; 13 (2) the electricity generated by the plant or facility is sold only to one 14 or more electric utilities that are regulated by the commission; and
01 (3) the person that constructs, owns, acquires, or operates the plant or 02 facility has not received from the state 03 (A) a grant that was used to generate the electricity from the 04 renewable energy resources; or 05 (B) a tax credit related to the generation of electricity from the 06 renewable energy resources. 07 * Sec. 2. This Act takes effect July 1, 2021.
