01 "An Act relating to regulation of certain food products."                                                               
02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
03    * Section 1. AS 17.20 is amended by adding a new section to read:                                                  
04 Sec. 17.20.025. Exemption for certain food products and facilities. (a)                                               
05 Except for meat, poultry, or a food product containing meat or poultry, the processing,                                 
06 preparation, packaging, and sale of a food product that the department determines is                                    
07 not potentially hazardous, is not subject to operating regulations and permit                                           
08 requirements under this chapter or AS 44.46.020 if the individual who is processing,                                    
09       preparing, packaging, or selling the food product                                                               
10                 (1)  is able, to the satisfaction of the department, to provide information                             
11       about the food product to the department and consumers;                                                         
12                 (2)  processes, prepares, packages, and sells the food product in the                                   
13       state;                                                                                                          
14                 (3)  labels the food product with information required by the                                           
15       department;                                                                                                       

01                 (4)  does not receive more than $50,000 in sales from the food product                                  
02       under this section in a calendar year;                                                                            
03                 (5)  sells the food product in the state and directly to consumers; and                                 
04                 (6)  displays information required by the department for consumers of                                   
05       the food product.                                                                                                 
06 (b)  Notwithstanding having an exemption under this section, a food product or                                          
07 an individual who is processing, preparing, packaging, or selling a food product                                        
08 subject to this section must be in compliance with other applicable statutes and                                        
09       regulations.
