00 HOUSE BILL NO. 275 01 "An Act relating to vaccines and vaccinations; relating to schools; and providing for an 02 effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 14.07.020 is amended by adding a new subsection to read: 05 (d) Notwithstanding (a)(7) of this section, the department may not adopt a 06 regulation requiring a child to receive a vaccine if the vaccine 07 (1) has not yet received formal approval by the United States Food and 08 Drug Administration; or 09 (2) is a human gene therapy product that has not yet been subject to a 10 complete long-term follow-up study period. 11 * Sec. 2. AS 14.30.125 is amended to read: 12 Sec. 14.30.125. Immunization. If, in the judgment of the commissioner of 13 health and social services, it is necessary for the welfare of the children or the general 14 public in an area, the governing body of a [THE] school district shall require the

01 children in that school district [ATTENDING SCHOOL IN THAT AREA] to be 02 immunized against the diseases the commissioner of health and social services may 03 specify. 04 * Sec. 3. AS 14.30.125 is amended by adding new subsections to read: 05 (b) Notwithstanding (a) of this section, a school district may not require a 06 child in that school district to receive a vaccine if 07 (1) the vaccine has not yet received formal approval by the United 08 States Food and Drug Administration; 09 (2) the vaccine is a human gene therapy product that has not yet been 10 subject to a complete long-term follow-up study period; or 11 (3) the school district only delivers instruction to the child through 12 telecommunications or other digital or electronic methods. 13 (c) In this section, "school district" means a borough school district, city 14 school district, regional educational attendance area, or state boarding school. 15 * Sec. 4. This Act takes effect immediately under AS 01.10.070(c).
