00 CS FOR HOUSE BILL NO. 226(FIN) am(efd fld) 01 "An Act relating to the compensation of certain employees of the executive branch, 02 judicial branch, and University of Alaska; relating to the compensation of certain 03 employees of the legislative branch; and increasing the salaries of certain attorneys and 04 administrative law judges employed by the state." 05 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 06 * Section 1. AS 39.27.011(k) is amended to read: 27 (k) Notwithstanding (a) - (j) and (l) of this section, the governor or a designee 28 of the governor may, on a case-by-case basis, authorize for a partially exempt 29 employee in the executive branch a higher pay than Step F. The authorization must be 30 based on a determination that the action serves a critical governmental interest of the 31 state, the employee possesses exceptional qualifications, recruitment difficulties exist,

01 or the action is necessary due to competitive salaries in the relevant labor market. A 02 determination made under this subsection must be in writing. 03 * Sec. 3. AS 39.27.011 is amended by adding new subsections to read: 04 (l) The amounts set out in the salary schedule contained in (a) of this section 05 are increased by 15 percent for positions within the Department of Law, the public 06 defender agency, and the office of public advocacy that require admission to the 07 practice of law in this state as a condition of employment, positions in the division of 08 legal and research services within the Legislative Affairs Agency, that require 09 admission to the practice of law in this state as a condition of employment and the 10 chief administrative law judge and administrative law judges of the office of 11 administrative hearings under AS 39.25.120(c)(20). 12 (m) The legislature shall increase the salary schedule in (a) of this section at 13 the same time and rate that the supervisory bargaining unit increases the salary 14 schedule for members of the bargaining unit. 15 * Sec. 4. AS 24.10.220; and AS 39.27.011(e) and 39.27.011(f) are repealed. 16 * Sec. 5. The uncodified law of the State of Alaska is amended by adding a new section to 17 read: 18 SALARY INCREASES FOR CERTAIN EXEMPT OFFICERS AND EMPLOYEES 19 OF THE EXECUTIVE BRANCH. The salary increases under AS 39.27.011(a), as repealed 20 and reenacted by sec. 1 of this Act, apply to public officers who are in the exempt service 21 under AS 39.25.110 and who are not members of a collective bargaining unit established 22 under AS 23.40.070 - 23.40.260 (Public Employment Relations Act) or otherwise covered by 23 AS 39.27.011(a). In this section, "public officers" includes permanent and temporary 24 employees in the executive branch, not including the governor, the lieutenant governor, or the 25 heads of principal departments of the executive branch. 26 * Sec. 6. The uncodified law of the State of Alaska is amended by adding a new section to 27 read: 28 SALARY INCREASES FOR CERTAIN EMPLOYEES OF THE JUDICIAL 29 BRANCH. (a) The salary increases under AS 39.27.011(a), as repealed and reenacted by sec. 30 1 of this Act, apply to permanent and temporary employees and magistrates in the judicial 31 branch of the state government who are not members of a collective bargaining unit

01 established under AS 23.40.070 - 23.40.260 (Public Employment Relations Act) and who are 02 not otherwise covered by AS 39.27.011(a). 03 (b) The salary increases applied by (a) of this section to permanent and temporary 04 employees and magistrates in the judicial branch of the state government who are not 05 members of a collective bargaining unit established under AS 23.40.070 - 23.40.260 (Public 06 Employment Relations Act) and who are not otherwise covered by AS 39.27.011(a), as 07 repealed and reenacted by sec. 1 of this Act, are increased by 10 percent for permanent and 08 temporary employees and magistrates in the judicial branch of the state government, other 09 than justices and judges, who are not members of a collective bargaining unit established 10 under AS 23.40.070 - 23.40.260 (Public Employment Relations Act) and who are not 11 otherwise covered by AS 39.27.011(a). 12 * Sec. 7. The uncodified law of the State of Alaska is amended by adding a new section to 13 read: 14 SALARY INCREASES FOR CERTAIN EMPLOYEES OF THE UNIVERSITY OF 15 ALASKA. The employees of the University of Alaska who are not members of a collective 16 bargaining unit are entitled to receive salary increases in accordance with the compensation 17 policy of the Board of Regents of the University of Alaska. 18 * Sec. 8. The uncodified law of the State of Alaska is amended by adding a new section to 19 read: 20 TRANSITION: REGULATIONS. The commissioner of administration or the 21 personnel board may immediately adopt regulations necessary to implement the respective 22 changes made by this Act. The regulations are not subject to AS 44.62 (Administrative 23 Procedure Act). The regulations may take effect after the effective date of the law 24 implementing the regulation.
