00 CS FOR HOUSE BILL NO. 226(STA) 01 "An Act increasing the salaries of certain attorneys and administrative law judges 02 employed by the state; and providing for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 39.27.011(k) is amended to read: 05 (k) Notwithstanding (a) - (j) and (l) of this section, the governor or a designee 06 of the governor may, on a case-by-case basis, authorize for a partially exempt 07 employee in the executive branch a higher pay than Step F. The authorization must be 08 based on a determination that the action serves a critical governmental interest of the 09 state, the employee possesses exceptional qualifications, recruitment difficulties exist, 10 or the action is necessary due to competitive salaries in the relevant labor market. A 11 determination made under this subsection must be in writing. 12 * Sec. 2. AS 39.27.011 is amended by adding a new subsection to read: 13 (l) Effective July 1, 2023, the amounts set out in the salary schedule contained 14 in (a) of this section, as increased under (e) and (f) of this section, are increased by 10

01 percent for attorneys under AS 39.25.120(c)(3) and the chief administrative law judge 02 and administrative law judges of the office of administrative hearings under 03 AS 39.25.120(c)(20). 04 * Sec. 3. The uncodified law of the State of Alaska is amended by adding a new section to 05 read: 06 TRANSITION: REGULATIONS. The commissioner of administration or the 07 personnel board may immediately adopt regulations necessary to implement the respective 08 changes made by this Act. The regulations are not subject to AS 44.62 (Administrative 09 Procedure Act). The regulations may take effect after the effective date of the law 10 implementing the regulation. 11 * Sec. 4. Section 3 of this Act takes effect immediately under AS 01.10.070(c). 12 * Sec. 5. Except as provided in sec. 4 of this Act, this Act takes effect July 1, 2022.
