00 HOUSE BILL NO. 224 01 "An Act relating to proposed annexation by a municipality." 02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 03 * Section 1. AS 29.06.040(c) is amended to read: 04 (c) In addition to the regulations governing annexation by local action adopted 05 under AS 44.33.812, the Local Boundary Commission shall establish procedures for 06 annexation and detachment of territory by municipalities by local action. The 07 procedures established under this subsection must include a provision that 08 (1) a proposed annexation must be approved by a majority of votes on 09 the question cast by voters residing in the annexing municipality; 10 (2) a proposed annexation must be approved by two-thirds of the 11 votes on the question cast by voters residing in the area proposed to be annexed; 12 and 13 (3) a proposed [OR] detachment must be approved by a majority of 14 votes on the question cast by voters residing in the area proposed to be [ANNEXED 15 OR] detached [;
01 (3) MUNICIPALLY OWNED PROPERTY ADJOINING THE 02 MUNICIPALITY MAY BE ANNEXED BY ORDINANCE WITHOUT VOTER 03 APPROVAL; AND 04 (4) AN AREA ADJOINING THE MUNICIPALITY MAY BE 05 ANNEXED BY ORDINANCE WITHOUT AN ELECTION IF ALL PROPERTY 06 OWNERS AND VOTERS IN THE AREA PETITION THE GOVERNING BODY].
