00 HOUSE BILL NO. 178 01 "An Act adding to the duties of the victims' advocate and the Department of Labor and 02 Workforce Development; and relating to informing certain peace officers, firefighters, 03 correctional employees, emergency medical technicians, paramedics, ambulance 04 attendants, emergency responders, and medical professionals of legal protections that 05 may be available if they become crime victims." 06 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 07 * Section 1. AS 23.10 is amended by adding new sections to article 7 to read: 08 Sec. 23.10.445. Posting of legal protections required. (a) The department 09 shall provide to an employer, upon request and without charge, copies of the summary 10 published by the victims' advocate under AS 24.65.100(e). 11 (b) An employer of a peace officer, firefighter, correctional employee, 12 emergency medical technician, paramedic, ambulance attendant, emergency first 13 responder, or medical professional covered under AS 12.55.135(d) or

01 12.55.155(c)(13) shall post in a conspicuous location in the employee's workplace a 02 copy of the summary published by the victims' advocate under AS 24.65.100. In this 03 subsection, "medical professional" has the meaning given in AS 12.55.135(k). 04 Sec. 23.10.450. Definition. In AS 23.10.430 - 23.10.450, "employer" includes 05 (1) a person who employs one or more other persons; 06 (2) the state; 07 (3) the University of Alaska; 08 (4) the Alaska Railroad; and 09 (5) political subdivisions of the state. 10 * Sec. 2. AS 24.65.100 is amended by adding a new subsection to read: 11 (e) The victims' advocate shall publish annually, on or before January 15, a 12 summary of the legal rights and protections provided to victims of crimes, including 13 rights and protections under AS 12.45.042, AS 12.61.010, 12.61.015, 12.61.016, 14 12.61.017, AS 33.20.080(b) and (c), AS 40.25.120(a)(6)(C), and this chapter, and 15 provide a copy of the summary to the commissioner of labor and workforce 16 development. The summary published under this subsection must include a statement 17 providing the grounds upon which 18 (1) a private person or peace officer may, without a warrant, arrest a 19 person under AS 12.25.030(a); and 20 (2) a criminal sentence 21 (A) is subject to a required minimum term of imprisonment 22 under AS 12.55.135(d); 23 (B) may be increased above the presumptive sentencing range 24 for specific conduct under AS 12.55.155(c)(13). 25 * Sec. 3. AS 23.10.430(c)(2) is repealed.
