00 CS FOR HOUSE BILL NO. 80(FSH) 01 "An Act establishing the sport fishing enhancement account; establishing the sport 02 fishing enhancement surcharge; and providing for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 16.05.130 is amended by adding a new subsection to read: 05 (h) Money accruing to the state from the sport fishing enhancement surcharge 06 imposed by AS 16.05.340(l) shall be deposited in a separate account known as the 07 sport fishing enhancement account within the fish and game fund. The department 08 shall allocate money in the enhancement account to programs intended to directly 09 benefit license purchasers as follows: 10 (1) $2.50 of each surcharge collected to fisheries management, 11 fisheries research, invasive species management, and habitat restoration; and 12 (2) the remainder of each surcharge collected to sport fishing stock 13 enhancement and ongoing maintenance of the department's sport fishing hatchery 14 facilities.

AS 16.05.340(i) is amended to read: 02 (i) If the commissioner determines that residents of the state are entitled to 03 obtain licenses for sport fishing, including sport fishing for anadromous king salmon, 04 in Yukon, Canada, for the same fees that are charged to residents of Yukon for 05 comparable sport fishing licenses, the commissioner may adopt regulations 06 authorizing residents of Yukon to receive 07 (1) nonresident annual sport fishing licenses for the fees charged to 08 residents under (a) of this section for a resident sport fishing license; and 09 (2) nonresident anadromous king salmon annual tags for the fee 10 charged to residents under (a) and (l) of this section for a resident anadromous king 11 salmon tag. 12 * Sec. 3. AS 16.05.340 is amended by adding a new subsection to read: 13 (l) In addition to the fees for a sport fishing license set out in (a) and (d) of this 14 section, each person who purchases a sport fishing license shall pay a sport fishing 15 enhancement surcharge as set out in this subsection. The purpose of the surcharge is to 16 provide funding for enhancement of sport fisheries. A person who is eligible for a $5 17 resident hunting, trapping, and sport fishing license under (a)(6) of this section or a 18 free license under AS 16.05.341 is exempt from payment of the surcharge imposed 19 under this subsection. The surcharge authorized by this subsection shall take effect on 20 the date established by regulation by the commissioner. The amount of the surcharge 21 attached to each sport fishing license must be clearly disclosed on the sport fishing 22 license. The amount of the sport fishing enhancement surcharge to be paid under this 23 subsection for each sport fishing license is as follows: 24 (1) resident sport fishing license .............. $ 6.50 25 (2) resident hunting and sport fishing license .......... 6.50 26 (3) resident hunting, trapping, and sport fishing license ... 6.50 27 (4) nonresident 14-day sport fishing license .......... 27.50 28 (5) nonresident seven-day sport fishing license ........ 22.50 29 (6) nonresident three-day sport fishing license ........ 12.50 30 (7) nonresident one-day sport fishing license .......... 7.50 31 (8) nonresident annual sport fishing license .......... 42.50
