00Enrolled HB 53 01 Relating to residency requirements for public school enrollment for certain children of active 02 duty military and National Guard members; and providing for an effective date. 03 _______________ 04 * Section 1. AS 14.03.080 is amended by adding a new subsection to read: 05 (g) A school district shall consider a student to be a resident of the district and 06 admit the student to a public school in the district if a parent or guardian of the student 07 is serving as an active duty member of the armed forces of the United States or a 08 member of the National Guard and is transferred or pending transfer under an official 09 military order to a military installation in the state from another military installation in 10 the state or from outside of the state. A parent or guardian of the student shall provide 11 to the school district written proof of residence in the state on an official document 12 within 30 days of the student's first day of attendance in the school district. In this 13 subsection,

01 (1) "guardian" has the meaning given in AS 13.06.050; 02 (2) "military installation" means a base, camp, post, station, yard, 03 center, homeport facility for a ship, armory, or other installation under the jurisdiction 04 of the United States Department of Defense or the United States Coast Guard; 05 (3) "residence" means the principal dwelling place of an active duty 06 parent or guardian. 07 * Sec. 2. This Act takes effect immediately under AS 01.10.070(c).
