00 CS FOR SENATE BILL NO. 91(FIN) 01 "An Act relating to the development and operation of a hydroelectric site at the 02 Nuyakuk River Falls; providing for the amendment of the management plan for the 03 Wood-Tikchik State Park; and providing for an effective date." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. AS 41.21.167 is amended by adding a new subsection to read: 06 (e) The development and operation of a hydroelectric site at the Nuyakuk 07 River Falls is a compatible use if the development and operation 08 (1) does not include a dam that fully spans a river; 09 (2) maintains at least 70 percent of the daily upstream water flow of an 10 affected river along the natural course of the river; and 11 (3) after July 1, 2024, is licensed by the Federal Energy Regulatory 12 Commission. 13 * Sec. 2. The uncodified law of the State of Alaska is amended by adding a new section to 14 read:
01 WOOD-TIKCHIK STATE PARK MANAGEMENT PLAN. The Wood-Tikchik State 02 Park Management Council shall, with the advice and assistance of the Department of Natural 03 Resources, amend the management plan for the Wood-Tikchik State Park to conform with the 04 change to AS 41.21.167 made in sec. 1 of this Act. 05 * Sec. 3. This Act takes effect immediately under AS 01.10.070(c).
