00 SENATE BILL NO. 51 01 "An Act requiring the designation of state water as outstanding national resource water 02 to occur by law; relating to the authority of the Department of Environmental 03 Conservation, the Department of Fish and Game, and the Department of Natural 04 Resources to nominate water for designation as outstanding national resource water; 05 relating to management of outstanding national resource water by the Department of 06 Environmental Conservation; and providing for an effective date." 07 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 08 * Section 1. AS 46.03 is amended by adding a new section to read: 09 Sec. 46.03.085. Outstanding national resource water. (a) Water of the state 10 may be designated as outstanding national resource water, as described in federal 11 regulation and this section, only by law. 12 (b) The department shall accept nominations of water for designation as 13 outstanding national resource water. The department may forward a nomination for

01 outstanding national resource water to the legislature only if the department, the 02 Department of Fish and Game, and the Department of Natural Resources agree to 03 recommend designation of the water to the legislature. 04 (c) Water of the state may not be managed as outstanding national resource 05 water unless the water has been designated as outstanding national resource water 06 under (a) of this section. 07 * Sec. 2. This Act takes effect immediately under AS 01.10.070(c).
