00 SENATE BILL NO. 30 01 "An Act establishing the middle college program for public school students; and relating 02 to the powers of the University of Alaska." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 14.07.168 is amended to read: 05 Sec. 14.07.168. Report to the legislature. Not later than the 30th legislative 06 day of each regular session of the legislature, the board shall prepare and present in 07 person to the legislative committees having jurisdiction over education an annual 08 report that describes the efforts of the board to develop, maintain, and continuously 09 improve a comprehensive quality public education system, as provided for under the 10 bylaws of the board. The report must include 11 (1) a summary of the resolves and rationales provided in support of 12 policy decisions made under AS 14.03.015; 13 (2) program and curriculum changes made, discussed, or 14 recommended in meetings held under AS 14.07.125;

01 (3) additional information relevant to efforts made to improve and 02 maintain the public education system; 03 (4) a summary of the middle college program established in 04 AS 14.30.780; the summary must include the 05 (A) number of students participating in the program; 06 (B) types of courses in which students have enrolled; and 07 (C) total number of credits that students have earned. 08 * Sec. 2. AS 14.30 is amended by adding a new section to read: 09 Article 15. Dual Credit. 10 Sec. 14.30.780. Middle college program established. (a) The middle college 11 program is established for eligible students to enroll in courses offered by the 12 University of Alaska. A student may earn both high school and college credit for each 13 course the student has satisfactorily completed. A student may attend a course in 14 person or by correspondence, as allowed by the University of Alaska. 15 (b) A student is eligible for the middle college program if the student 16 (1) is enrolled in public school in the state; 17 (2) has completed the 10th grade; 18 (3) has not been awarded a high school diploma; and 19 (4) complies with the requirements of the program. 20 (c) Every school district shall participate in the middle college program. The 21 school district in which a student is enrolled shall pay the student's tuition, at the 22 University of Alaska's resident tuition rate, for a course offered through the program. 23 The student is responsible for all other expenses, including fees, books, and 24 transportation. 25 (d) For the purpose of calculating a school district's ADM under 26 AS 14.17.410, a student participating in the middle college program is considered a 27 full-time student of the school district in which the student is enrolled. 28 (e) The University of Alaska and a school district may release to each other 29 the transcript of a student to determine the student's eligibility for the middle college 30 program or for graduation. 31 (f) In this section, "school district" has the meaning given in AS 14.30.350.

01 * Sec. 3. AS 14.40.040(a) is amended to read: 02 (a) There is created and established a corporation to be called the University 03 of Alaska. It may in that name 04 (1) sue and be sued; 05 (2) receive and hold real and personal property; 06 (3) contract and be contracted with; a contract entered into by the 07 University of Alaska for the 08 (A) rent or lease of premises for use and occupancy by the 09 University of Alaska is subject to AS 36.30.080(c); however, notwithstanding 10 the limitation imposed by AS 36.30.080(c)(2), the Board of Regents of the 11 University of Alaska 12 (i) may enter into a lease with a term described in (ii) of 13 this subparagraph if the rent under the lease will be paid solely from a 14 grant or contract made by the federal government or an agency of the 15 federal government, and the grant or contract contains a firm 16 commitment of not more than two years, or if the rent payable under 17 the lease will be paid solely from university receipts as that term is 18 defined in AS 14.40.491; and 19 (ii) when authorized by (i) of this subparagraph, may 20 enter into a lease with an initial term equal to the period of the firm 21 commitment of the grant or contract, or with an initial term not to 22 exceed two years when the rent is payable from university receipts; the 23 lease may contain one or more optional renewal periods, but the total of 24 all optional renewal periods may not exceed an additional five years; 25 (B) acquisition of property by a lease-purchase or lease- 26 financing agreement for the benefit of the University of Alaska is subject to 27 AS 36.30.085; 28 (4) adopt, use, and alter a corporate seal; 29 (5) borrow money, issue debt, or enter into long-term obligations for 30 the purchase of facilities, goods, or services; the obligations may secure, in whole or in 31 part, debt issued by another party;

01 (6) do and have done all matters necessary for the purpose of any 02 function set out in this chapter; 03 (7) enter into an agreement with a school district for the purpose 04 of carrying out the middle college program established in AS 14.30.780.
