01 "An Act relating to the powers of the Department of Transportation and Public                                           
02 Facilities; and relating to the sale, transfer, or disposal of state ferries."                                          
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
04    * Section 1. AS 19.05.040 is amended by adding a new subsection to read:                                           
05            (b)  Notwithstanding (a) of this section, the department may not sell, transfer,                             
06       or otherwise dispose of a ferry without first obtaining legislative approval by law. In                           
07       this subsection, "ferry" has the meaning given in AS 19.65.030(g).                                                
08    * Sec. 2. AS 19.65.060(a) is amended to read:                                                                      
09            (a)  There is created, as a special account in the general fund, the Alaska                                  
10       marine highway system fund, into which shall be deposited                                                         
11                 (1)  the gross revenue of the Alaska marine highway system;                                             
12 (2)  money that is appropriated to the Alaska marine highway system                                                     
13 fund by the legislature in an amount that is consistent from year to year and is the                                    
14 amount necessary, after consideration of gross revenue, to provide stable services to                                   

01       the public consistent with the provisions of AS 19.65.050(b)(4), which appropriations                             
02       are not one-year appropriations and the balances of which do not lapse under                                      
03       AS 37.25.010; [AND]                                                                                               
04                 (3)  any other money that is appropriated to the Alaska marine highway                                  
05       system fund by the legislature, which appropriations are not one-year appropriations                              
06       and the balances of which do not lapse under AS 37.25.010; and                                                
07                 (4)  the proceeds from the sale, transfer, or disposal of a ferry,                                  
08       except for proceeds that are required to be used for an eligible purpose under 23                             
09       U.S.C.
