00 CS FOR HOUSE BILL NO. 247(FSH) 01 "An Act relating to the fish and game fund; relating to a sport fishing surcharge; 02 providing for an effective date by amending the effective date of sec. 21, ch. 18, SLA 03 2016; and providing for an effective date." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. AS 16.05.130(e) is amended to read: 06 (e) Money accruing to the state from the sport fishing enhancement 07 [FACILITY] surcharge imposed under AS 16.05.340(j) shall be deposited in a 08 separate account known as the [ALASKA] sport fishing enhancement 09 [ENTERPRISE] account within the fish and game fund. The department shall 10 allocate money [MONEY] in the enhancement [ENTERPRISE] account to 11 programs [SHALL BE ALLOCATED TO SPORT FISHING FACILITIES] intended 12 to directly benefit license purchasers as follows: 13 (1) $2.50 of each surcharge collected to fisheries management, 14 fisheries research, invasive species suppression and eradication, habitat
01 restoration, and ongoing maintenance of the department's sport fishing facilities 02 and sport fishing hatchery facilities; and 03 (2) the remainder of each surcharge collected to sport fishing stock 04 enhancement and ongoing maintenance of the department's sport fishing 05 hatchery facilities. [MONEY IN THE ENTERPRISE ACCOUNT MAY BE 06 PLEDGED TO PAY THE PRINCIPAL OF AND INTEREST ON REVENUE 07 BONDS ISSUED UNDER AS 37.15.765 - 37.15.799. THE COMMISSIONER 08 SHALL SEEK AUTHORITY FOR THE TRANSFER OF AMOUNTS 09 DETERMINED UNDER AS 37.15.783 FROM THE ENTERPRISE ACCOUNT TO 10 THE REDEMPTION FUND ESTABLISHED IN AS 37.15.770.] 11 * Sec. 2. AS 16.05.340(j) is amended to read: 12 (j) In addition to the fees for a sport fishing license set out in (a) and (d) of this 13 section, each person who purchases a sport fishing license shall pay a sport fishing 14 enhancement [FACILITY] surcharge as set out in this subsection for the purpose of 15 providing funding for enhancement of sport fisheries [SPORT FISHING 16 FACILITIES]. A person who is eligible for a $5 resident hunting, trapping, and sport 17 fishing license under (a)(6) of this section or a free license under AS 16.05.341 is 18 exempt from payment of the surcharge imposed under this subsection. [THE 19 SURCHARGE AUTHORIZED BY THIS SUBSECTION SHALL TAKE EFFECT 20 ON THE DATE ESTABLISHED BY REGULATION BY THE COMMISSIONER. 21 THE AUTHORITY OF THE DEPARTMENT TO COLLECT THE SURCHARGE 22 UNDER THIS SUBSECTION TERMINATES ON DECEMBER 31 OF THE 23 CALENDAR YEAR IN WHICH THE PRINCIPAL AMOUNT OF THE BONDS 24 ISSUED UNDER AS 37.15.765 - 37.15.799, TOGETHER WITH THE INTEREST 25 ON THEM AND ANY INTEREST OWING ON UNPAID INSTALLMENTS OF 26 INTEREST, AND ALL OTHER OBLIGATIONS WITH RESPECT TO THE 27 BONDS, ARE FULLY MET AND DISCHARGED.] The amount of the surcharge 28 attached to each sport fishing license must be clearly disclosed on the sport fishing 29 license. The amount of the sport fishing enhancement [FACILITY] surcharge to be 30 paid for each sport fishing license is as follows: 31 (1) resident sport fishing license ............. $ 6.50 [9]

Section 34, ch. 18, SLA 2016, is amended to read: 12 Sec. 34. AS 16.05.100(2), [16.05.130(e),] 16.05.130(f) [, 16.05.340(j)]; 13 AS 37.15.765, 37.15.770, 37.15.773, 37.15.777, 37.15.780, 37.15.783, 37.15.787, 14 37.15.790, 37.15.793, and 37.15.799 are repealed. 15 * Sec. 4. The uncodified law of the State of Alaska enacted in sec. 35(a), ch. 18, SLA 2016, 16 is amended to read: 17 (a) Section [SECTIONS 21 AND] 34 of this Act takes [TAKE] effect only if the 18 commissioner of fish and game notifies the revisor of statutes in writing as required under (b) 19 of this section. 20 * Sec. 5. Section 21, ch. 18, SLA 2016, is repealed. 21 * Sec. 6. The uncodified law of the State of Alaska is amended by adding a new section to 22 read: 23 TRANSITION: DISPOSITION OF FUNDS. Funds remaining in the sport fishing 24 enterprise account after bond obligations are discharged shall be transferred to the sport 25 fishing enhancement account on the effective date of secs. 1 and 2 of this Act. 26 * Sec. 7. The uncodified law of the State of Alaska is amended by adding a new section to 27 read: 28 CONDITIONAL EFFECT. Sections 1 and 2 of this Act take effect only if the 29 conditions described in sec. 35, ch. 18, SLA 2016, are met. 30 * Sec. 8. Section 36, ch. 18, SLA 2016, is amended to read: 31 Sec. 36. If, under sec. 35 of this Act, sec. [SECS. 21 AND] 34 of this Act
01 takes [TAKE] effect, it takes [THEY TAKE] effect January 1 of the calendar year 02 following the year of notice under sec. 35 of this Act. 03 * Sec. 9. If, under sec. 7 of this Act, secs. 1 and 2 of this Act take effect, they take effect 04 January 1 of the calendar year following the year the conditions in sec. 7 of this Act are met. 05 * Sec. 10. Except as provided in sec. 9 of this Act, this Act takes effect immediately under 06 AS 01.10.070(c).
